Principles for implementing duty of care in health, social care or children’s and young people’s setting. – CT236
1.1 - It is a way of saying that you are responsible for the welfare of yourself and of others. If you ignore this duty, you are breaking the rules. These rules are set to ensure nobody is missed or forgotten about, and is primarily about preventing accidents. To explain what it means, it means you are responsible for people's well-being.
1.2 - When caring for the elderly, or anyone who is unable to care for themselves, besides meeting their physical, emotional, and spiritual needs, a major duty is ensuring their safety and protecting them from injuries or from those who would take advantage of them. situation where someone who is very ill wants to discharge themselves from hospital or refuse treatment. The duty of care of medical staff is to treat the patient. There's a conflict if the patient exercises their right to refuse that care.
2.2 - Carry out a risk assessment.
You will then have carried out your duty of care to do what is reasonably expected of you to safeguard the individual and you have provided for the individuals rights to make informed choices.
2.3 – The manager/ deputy manager, MENCAP, IMCA, DOLS, social workers, g.p. surgeries, psycho geriatricians etc.
3.1 – Listen to what the individual has to say, go to managers office, describe the complaint to the manager, ask for advice for the proper reply, evaluate and respond appropriately to the original individual.
3.2 – Frontline Resolution; for issues that are straightforward and easily resolved, requiring little or no investigation. ‘On-the-spot’ apology, explanation, or other action to resolve the complaint quickly, in five working days or less, unless there are exceptional circumstances.
Investigation; for issues that have not been resolved at the frontline or that are complex, serious or ‘high risk’. A definitive response provided within 20 working days following a thorough investigation of the points raised. Sensitive complaints that meet set criteria may have the opportunity for additional internal
review.
Independent external review; For issues that have not been resolved by the service provider. Complaints progressing to the SPSO will have been thoroughly investigated by the service provider. The SPSO will assess whether there is evidence of service failure or maladministration not identified by the service provider.
