The major workplace legislation in Australia is the Australian Government who regulate the workplace legislation via Fair Work Act 2009 (Commonwealth). My work organisation operates under Federal jurisdiction, or where applicable, Queensland jurisdiction in line with the Fair Work Commission (FWC).
The FWC’s functions include the setting and varying of modern awards, minimum wage fixation, dispute resolution, the approval of enterprise agreements, and handling claims for unfair dismissal.
FWC is an independent body with the power and authority to regulate and enforce provisions relating to:
1. the safety net of minimum wages and employment conditions
2. enterprise

An Award agreement is a legally enforceable written document or determinations of an industrial tribunal that sets out minimum conditions of employment for employees doing a particular job. An example of this would be the Award wage rate for an industry. This means that an employer needs to pay this wage rate at a minimum to their employee.
An Enterprise agreement is set out conditions of employment between an employer, and an employee or groups of employees. They are written documents and the following requirements must be met in order for approval by Fair Work Australia:
• Employer and employee must have genuinely agreed to the agreement;
• Terms of the agreement must not contravene the National Employment Standards;
• Employees must be ‘better off overall’ by entering into the agreement;
• Fair Work Australia must be satisfied that the group of employees who will be covered by the agreement was fairly chosen;
• Agreement must not contain any unlawful terms;
• Nominal expiry date must be no more than four years after the date of

Industrial relations policies are the regulations that describe how the organisation manages its operational processes in order to be able to achieve the organisations strategic and business objectives within a quality framework.
An industrial relations procedure is the step by step guideline that describes how to implement or action the policy in a particular situation.
Within my organisation, the industrial relations policies and procedures are communicated via the intranet. They are accessible by all staff and are reviewed on a regular basis. If changes are made to any of these policies and procedures, they are communicated directly to the managers to add to agenda items for team meetings. If they are considered a significant change or one that is to be communicated immediately, an email would be sent to all staff.
