A Pre-Employment Background Check has become a matter of necessity. Too many applicants make false claims on their job applications and resumes or attempt to cover up prior criminal activity. About 40% of the background checks processed by A Matter of Fact turn up at least one serious discrepancy. To view the statistics gathered by A Matter of Fact from our years of experience and from other industry sources see Background Check Statistics.

Everyone has their favorite story about falsified credentials and phony work experience. See Classic Employer Nightmares. Stories like these can be avoided by careful applicant background screening.

The Pros of Employee Background Checks

Why do background checks? The benefits of comprehensive employment background screening include: increased applicant and new hire quality, reduced workplace violence, reduced negligent hiring liability, reduced losses from employee dishonesty, making the right hire the first time, and avoiding negative publicity. The bottom line is that pre-employment background checks help an organization be more successful. That means greater profits to for-profit organizations and greater impact for non profits. For more about the benefits of background checks for non profits, see Non Profit Background Checks: Employee & Volunteer Screening. back to top
Increase Applicant and New Hire Quality

The first benefit of background checks that most clients see is an increase in applicant quality. We often hear from our new customers that they saw an almost immediate improvement in the quality of applicants once the word got out that they were conducting thorough background checks. A complete employee screening process: * Results in fewer applications with serious discrepancies * Discourages applicants who are trying to hide something * Increases applications from applicants who want to work in a safe environment * Increases the quality of new hires due to an improved applicant

According to the law case EEOC v. FREEMAN, the EEOC filed a law suit against Freeman and alleged the company’s hiring policy which includes criminal background and credit history checks, has a disparate impact on African-American, Hispanic, and male applicants. And the material fact of this case is whether Defendant’s hiring criteria of conducting criminal background and credit history checks is consistent with business necessity. Since the Defendant was charged by the EEOC with unlawful discrimination in this case, the source of law is the Title VII of Civil Rights Act of 1964. “Title VII prohibits discrimination in hiring, firing, trainings, promotion, discipline, or other workplace decisions on the basis of an employee or applicant’s race, color, gender, national origin, or religion” (Bennett- Alexander & Hartman, 2011).…

When it comes to my point of view about this topic it is also circumstantial. I think if you have convicted of a lesser felony and you are trying to get your life straight then you should get a second chance. Companies should not quickly shone those with these lesser convictions. Those convicted of violent crimes should get a second chance also but should screened very well by the employer before even considering hiring these individuals. Those convicted of sexual felons such as molestation and rape should have never been released.…

Registration is not required to perform a background check now and won’t be necessary with wider background checks. Wider background checks would include all mental health issues and not just involuntary hospital stays. While some say this violates privacy laws, this would be necessary as shown by the case with Mr. Houser. For wider background checks to work effectively law enforcement will need to report and maintain its records. Without law enforcements information, the database will not prevent sales that should be denied to criminals. Although some states complain they don’t have the proper funds to keep better records and to report to the FBI but the government has helped some states with the funding and is willing to help others to ensure the public’s safety. Criminal history and job opportunity is a major concern for a number of businesses, schools, and organization due to a growing number of inmates being released from prison, and entering into the labor market (Pager, 2006). According to the Bureau of Justice (2015), a total of 646,881 inmates were released from prison throughout the United States. These inmates will be required to seek employment. I find that most of these disciplinary actions will begin to become less frequent in our industry due to the reversions of licensure selection to begin with. Our industry is being securitized, just as insurance or brokerage, and with strict qualifications of FBI background checks, credit checks, and personal history review – a lot of scrupulous characters won’t have the ability to get to a point where they can afflict any improprieties on the system or the public at large. The pre-screening process also includes the administration of competency testing – all…
