Without Consent
On the evening of October 12th, 2016 I attended an event called “Got Consent” sponsored by learning beyond the classroom. During this event, Officer Dorcey and several guest speakers spoke about domestic violence and sexual consent. In this paper, I will argue that without consent or while under the influence of alcoholic substance it is not okay to pursue sexual activity. I will argue this by giving exemplification from the occasion I have previously mentioned attending and my experiential perspective on this subject matter. Critics will indicate that while intoxicated a person may be able to approbate intercourse. Critics are mistaken because the law prohibits usage of a motor vehicles while inebriated, if a person cannot efficiently comprehend …show more content…
My belief is that all of these things I have listed are morally unjust, and liable for punishment by law enforcement. I believe this because to be harassed, disturbed, or bodily affected in whatsoever undesirable way is distressingly serious. For instance in a lawsuit recently filed against a young male who competitively swam for and attended Stanford University by the name of Brock Turner. Brock sexually assaulted a young woman who was intoxicated as well as he was behind a dumpster in an alley. Thankfully a jogger noticed the spectacle and reported the horrifying scene to the authorities. The women he sexually assaulted later woke up in the hospital scared, and alone with no recognition of her purportrater. In court Brock was sentenced to the minimal sentence of three months in Santa Clara County Jail due to his academics, and sportsmanship the California Judge Aaron Persky who was later suspended decided not to “ruin” Brock’s future. In my opinion this is gravely disturbing, this young woman's life will forever be affected by Brock’s choices on this night, but his life will only be paused for a few months. The most disconsolate fragment in the case of Brock vs. The People is that Judge Aaron Persky’s decision is affirmed which is defined as the order being found valid and will stand as decided. This means there will never be true justice for the women who lost so many things that night including her personal values, dignity, respect, and most of all her rights as an American

In the September 6 issue of the LA Times, reporter Sarah Parvini published an article about a former rapist registering as a sex offender, and his sentence. Ex-Stanford swimmer, Brock Turner, was convicted of sexually assaulting a woman behind a dumpster. The woman was completely unconscious and due to this, he was charged with three felony counts: assault with the intent to commit rape of an unconscious person, sexual penetration of an unconscious person and sexual penetration of an intoxicated person. Turner originally faced 14 years and jail but got 6 months instead. He was later released 3 months earlier than his 6-month sentence because of good behavior. This article contains conflict, drama, and oddity. This story contains a man vs.…

I have a huge issue with the sentencing of Brock Turner, a former student of Stanford University. Turner was charged and convicted of three counts of felony sexual assault. He sexually assaulted a 22 year-old-woman who was unconscious and intoxicated behind a dumpster on the college campus. At the end, the judge sentenced turner to six months in a county jail and three years of probation. He also must register as a sex offender, and participate in a sex-offender treatment program. Turner is scheduled to be released tomorrow from a county jail – three months early for good behavior.…

There are times when people drive home under the influence of alcohol. Many times, people get home without getting pulled over by the local police department, sheriff’s department or the state patrol. Drivers who do get pulled over for drunk driving will be arrested and need to hire an attorney. Lawyers represent men and women in the courtroom, and negotiate lighter sentences with judge and district attorney’s office, there are even times when the case gets dismissed altogether even those the individual were clearly impaired behind the wheel breaking the law. My argument for my paper is whether or not there should be stricter DUI laws in the state of Wisconsin.…

In summary this article was about (as just mentioned) how the possession laws and the purchase laws are saving hundreds of lives every year (alcohol highway state legislation). This article was about a research project that studied the differences in car accidents involving drivers under the influence and drivers who were completely sober whose collision was truly an “accident.” The study found that from 1986-2004, there was a decrease every year in the amount of fatal crashes due to driving under the influence, and these decreases was credited to the possession, purchase, zero tolerance, and use and lose laws (Digests of State Alcohol Highway Safety Related Legislation). These strict…

This prestige student was convicted of raping an unconscious girl behind a dumpster and with several pleadings from the mother and father they had convinced the judge along with the courthouse to let Brock walk free after only serving three months out of the six months given. Although there is no universal sentence for the crime of rape, the average time a convict is sent to prison for the crime of rape is around nine years and even so, most of the inmates get out after an average of five to six years. This is no-where near as much time as what the Student Brock did for his crime. This was most likely the result of the judge and the court agreeing on how being in jail for a white middle-class college student would set a bad reputation not only for the student, but also the impression in addition with the stereotypes of the social class therefore they let him free after such a short amount of time. This is an effect of the own-race bias, helping and noticing more on a psychological level the same race. This form of corruption must end, one solution to this is to have a certified punishment for a specific crime since there is no ‘universal sentence’ for a crime, at least but a minimum barrier. For example, if the crime committed was rape, the defense system could have a law where the minimum rule is five years and depending…

In America, it is pronounced that everyone has equal rights, so who we are should not matter to a court of law. In these readings, if someone with authority decides that a certain race or religion is faulty in any way, everyone must comply with what they believe to be true, even in the worst case circumstances. Power is used in evil ways and it is seen throughout the cases involving Gordon Hirabayashi, Lloyd Barenblatt, Al- Hussayen, and al-Kidd with violation of their Constitutional rights and within the other philosophical readings. Power is taken for granted by the people who are in authority over it and used against American citizens in cruel ways. The cases were all not made morally correct and even went against Constitutional rights. History can be seen to repeat itself in the ways of evil authority and compliance of…

Corey Friedman’s Lawmakers Target Drunk Drivers, appeared in North Carolina’s “Wilsons Daily Times” on February 18, 2013. In his essay, Friedman, explains new bills and laws that are trying to get passed by North Carolina’s congress. They will target and prevent drunk driving across the state by developing harsher laws and consequences for those found guilty of these offenses. Friedman uses many different perspectives on the issue by restating various North Carolina state representatives, and various group advocates among Mothers Against Drunk Driving (MADD). These many opinions on the new bills proposed to the North Carolina state legislature proved significant recognition of the issue by many across the state along with Friedman.…

Drinking and driving is a gift put on earth by the almighty God. I mean why wouldn’t it be possible if he didn’t want us to do it? Alcohol is the greatest past time in Earth’s history. What’s not great about it? It can lead to vomiting, passing out, waking up in random people’s beds, and sometimes even death. Isn’t that four of the greatest feelings in the world? The death part mostly comes from the beautiful cause of drinking and driving. But don’t listen to what statistics say, keep doing it, because you know what they say, “Practice makes perfect.” There’s nothing better than getting into a car after fifteen beers and running head on into a tree and killing yourself. Unfortunately, the general population or I like the thought of someone getting behind the wheel under the influence and taking the lives of the innocent. So I’ve came up with a modest proposal to put an end to drinking and driving.…

However, when I came through the door, I may just as well dismissed everything; Believe me in no way was it what I thought it would be.…

Alcoholism is a predisposed disease and is rapidly growing to become a very domineering issue in our society. While paying attention to various news broadcasts and newspapers, I have found that different domestic abuse cases and murders have been under the influence of alcohol. It really pains me to see teens in my own society fall victim to the influence. Alcohol can cause males to abuse females physically, mentally, and emotionally. In my own life, I have witnessed my aunt being abused countless times when my uncle would consume a couple of beers. I didn't understand it at the time because I thought that she did something wrong. I feel very wrong in expressing this, but I feel that when people consume alcohol, the truth comes out. Alcohol is a truth serum because you are not in a coherent state of mind, therefore you are not aware of what you are saying. Due to alcoholism, one out of every three women have to deal with domestic abuse. My heart aches for the women and I pity the men who feel that they have to belittle women and beat them because they know that some women will blame it on their being drunk. Domestic abuse cases often get thrown out because the women blame it on the man's drunken state. I inform anyone in this situation to get help because it is not healthy or suitable for…

Underage drinking is one of the biggest problems facing America today. Teens who abuse alcohol often turn to a life of crime, or suffer mental or physical breakdowns. In many cases the teen may even die from attempt suicide or car accident. In Montgomery Country two teenager was killed in a car accident, after leaving a party drunk and driving over the speed limits. Knowing that they were underage, if the father who hosted the party had never let the teens drink, then the two death could have been prevented (Fitzgerald. Par. 1-4). This is of course an extreme case of alcohol usage among teens, and it is often not this severe. The best way to prevent underage drinking is to start family planning and prevention programs at an earlier age.…

The reason I believe everyone deserves to be punished for their action is because my sister recently was a victim of what the cops said was a class three sexual assault. He was eighteen and my sister is only thirteen, and it was non-consensual. The guy has slight mental issues, and even dropped out of school because of them. The cops warned us that this might hurt our chances of getting charges filled on him. I do not agree that a person’s mental status can give them a free pass for breaking the law. Now from the case not being taken my sister feels not only violated by him, but by the law also. She feels like the law doesn’t believe her. He has been caught on exposing himself to others before, and he seems to now be escalating. It seems like it’s going to take him to do way worse before maybe the District Attorney will do something with him. Until this action is ever possibly taken on him, he’s getting to walk free for what he did to my sister; while my sister is left confused, angry, and violated. I don’t see why just because someone might have a little mental problem that they don’t get punished for what they do. Everyone that breaks the law deserves to get punished for…
