The smallest act of crime can often lead to inner adversity. For instance, Johnny’s parents would beat him and left him feeling safer in a gang or in a parking lot. Due to the parents hurting Johnny he was forced to live a life in a gang, a life of crime, and violence.…
In chapter “Wilma Derksen”, Malcolm Gladwell talks about different way of using power. There are two words that important to understand the chapter are “crime” and “repercussions”. The first word is crime; this word means an offensive action that may be prosecute by state. This chapter talks about the limit of power through the ways that people uses to react to crime. We can see this word repeats all over this chapter. The second word is repercussions; this word means a bad consequence occurring after an welcome action or event. Gladwell uses this word when he talks about the effect of Three Law Strikes. We all think that the Three Law Strikes is good; it will help decrease the number of criminals. However, it causes some major repercussions…
I think that this was an unfortunate thing that happened to this young boy and I wish that someone would have gotten him help before it was too late. I think that Jacob should have received a life sentence without parole because he chose to murder his mother and step-father and he was old enough to know right from wrong. I feel like he should’ve reached out and tried to get help at school. Jacob’s brother, Charles speculated that he thought his mother knew what was happening, so for Jacob to take her life without knowing if she was aware of the situation makes me lean more towards him deserving to be in jail. I know Jacob must have been angry and that because of his anger he killed them both, but I do not think Jacob had a reason to kill his mother, due to Charles statement resembling…
Beginning in the early 1990s, states began to enact mandatory sentencing laws for repeat criminal offenders. These statutes came to be known as "three strikes laws," because they were invoked when offenders committed their third offense. By 2003 over half the states and the federal government had enacted three strikes laws. The belief behind the laws was that getting career criminals off the streets was good public policy. However, incarceration of three strikes inmates for 25 years to life would drive up correctional costs. The U.S. Supreme Court has upheld three strikes laws and has rejected…
Thesis: The United States does not subject prisoners to cruel and unusual punishment as stated in the constitution…
The case of the woman who had served 36 years in prison illustrated some effects of abuse on a teenager. She was looking for attention and love, because she was from an abusive family. She went to rob the store with her boyfriend to sustain the friendship, but it landed her in the prison because the boyfriend killed the owner of the store. She did not think of the consequence of her action because she was looking for love. I feel the action of this woman also portrayed a characteristic of some teenagers who do bad things because of peer pressure.…
It ignores the possibility of unremorseful offenders and unwilling victims, challenges the criminal justice system operation, undermines the law- that define crimes and send offenders to prison, as well as outline the rights that protect citizens from the government. Crime can ruin lives, destroy relationships, and a mediated conversation can’t heal every wound, or address the problem at large. It reduces the legitimacy of law, which citizens are required to abide by, and believe in. The lack of established process results in discrepancies in outcomes; refuting the idea of equality before the law. Objectivity is essential to due process, and working with the victim eliminates the possibility of legitimate and fair consequences. This includes both extremes, harsh punishment for a minor crime and or no punishment for a harsher crime. The decision rests in the hands of a common citizen, who is usually virtually uneducated of the process of law as compared to appointed justices. Justices are appointed to fairly evaluate the situation and proceed in accordance with the law, and restorative justice can give too much power in the hands of those in the…
In today's society more and more juvenile delinquents are being charged as adults in the court systems. The youth are being condemned by a society that allows fear to control its decisions. In the film Juvies narrated by actor Mark Wahlberg, a former juvenile offender, the lives of a group of young kids who are sentenced for many years or life are told. Throughout the film the group explains why they did what they did and how they wished they could have done it differently.…
Foucault’s interpretation of punishment differs to a large extend from Durkheim’s. The first believes that punishment is utilitarian and instrumental in nature, and the second argues that it is mainly moral and emotional. Foucault fails to accept that there are aspects of the penal system that malfunction, a problem which is not present in Durkheim’s study because of the sentimental principles of punishment. However, Niveen was not punished by the society after upsetting their ‘conscience collective’; instead she was punished by psychiatrists and counselors. The modern juridical system punishment transformed the mother into a failure in front of the people. If she would have been punished in a more physical and violent way, as it used to be,…
According to the story, the human understanding of justice is that it revolves around the actions assumed by the law rather than the actual outcomes. The idea of justice constructed upon the process accepted is based on the simple fact that it ensures that all the pertinent issues are addressed. Additionally, if the process is not followed correctly, it’ll become too complex to explain to the accuser how an action done good to them will now make up for an action done wrong to them before. This idea should be applied in today’s culture because the public is accountable for serving justice and it is obligated to follow the correct process in doing so…
There are many different rules in Jonas’ society. At breakfast you must tell your dreams to the family. Lying is another rule and it has major effect on the society. Other rules on the other hand don’t have the same effect, children under the age of nine aren’t allowed to ride bikes is one of those rules (pg.17). Jonas said that most children don’t…
"Who shot me? You punks didn't finish; now you're about to feel the wrath of a menace, I hit em' up." A quote from late Tupac Shakur and most young men's anthem and golden rule they live by.…
The woman presses charges against the thief. Then after seeing the thief at the market using the stolen money to buy a coffin for his son, she decides to drop the charges. For example, she says, "Can I pay for the young man's fine or give him the money to return and thus erase the crime?" When the thief finds out that the charges are going to be dropped, he says, "I do not need the American senora to bury my child. If I pay for his funeral by spending six months in prison, that is my choice. I am the father. If the senora cannot understand this, it is not my concern." In other words, the thief will pay for his son's death by going to jail before having an American woman paying for his son's death. The thief learns that he should have earned the money to buy his son's coffin by himself. Earning money honestly by working hard would have been a better choice than spending time in prison.…
Three of the big ideas from the course are justice, duty and ethics. Justice is defined as the quality of being just; righteousness, equitableness, or moral rightness. Duty is something that one is expected or required to do by moral or legal obligation. Ethics is a system of moral principles ("Dictionary.com - The world's favorite online dictionary!," n.d.). Through the scenario I learned that justice is very important for the victim because it gives some sort of closure. Since laws plays an important role in our society it's important that justice is distributed fairly you can't punish someone to harshly or lightly, the time needs to equal the crime. Even if they’re a criminal they still deserve basic rights such as an attorney to defend…
It is a common consensus that the issue on the demonstration of strike is becoming increasingly a central issue as the democratic principles continue to progress and evolve in our current society. There are diversity of view that concern the act of labor strike, and some prominent aspects embedded in the demonstration of strike come to raise some questions. The debate on both the frequency and the reason of the occurrence of strike in various working environments is significantly the most controversial challenge of the issue.…
