Reflective Summary Observation
On 05/15/16 at approximately 2055 hours, while on patrol in the area of Nebraska Ave. N. and Columbus Dr. E., I observed two subjects standing at the front entrance of the Sunoco Convenience store located at 2317 Nebraska Ave. N. The black male subject was straddling a bicycle and the white female subject was standing next to him. The white female was holding a beverage in her left hand that was wrapped in a brown paper bag. Upon sight of my patrol vehicle, the female subject attempted to concealed the beverage on the left side of her body. As I continued to drive North on Nebraska Ave., the female subject continued to turn her body in order to conceal the beverage. A beverage wrapped in a brown paper bag is commonly used for the purchase of an alcoholic beverage.

Due to the suspicious behavior, I parked my patrol vehicle next to the gas pump in front of the business. As I walked toward the subjects, the female placed the beverage down on a newspaper bin and walked away. I observed the top rim of the beverage to be an open Steel Reserve beer can. I picked up the can, which was half consumed and still cold to the touch.

An FCIC/NCIC record check was conducted on Hall for wants/warrants and was met with negative results. However, the record check revealed Hall was previously issued a trespass warning on 12/28/15 by TPD Ofc. Barrett and later arrested (See TPD Report #15-730982 & #15-730421).

A Criminal Report Affidavit (CRA) was filled out and Hall was issued a Notice To Appear (NTA) for trespassing after warning. Her right thumb print was obtained and she was released from the scene without incident.

A copy of the original trespass warning was copied and placed into evidence. Hall was issued a new trespass warning for the business (See TPD Report

    Mr. and Mrs. Ruiz’s complaint against Safeway involved the death of their son, Alexander Ruiz. Alexander was killed when, Dylan Morse, an 18-year-old alleged drunk driver struck his car. Mr. and Mrs. Ruiz wanted to hold Safeway responsible because, shortly before the accident, a Safeway clerk sold alcohol to Mr. Morse’s passenger, Ryne Spitzer (Law.com, 2012).
