Essay On Walmart Observation
On the above date and time I was conducting traffic enforcement in the area of Richey Drive and Wilkins Street.

While traveling South on Wilkins Street, I observed a black, Ford Ranger traveling in the same direction. I was directly behind the vehicle exiting Walmart. As the vehicle approached the stop sign, it faled to stop and traveled straight through the traffic control device without attempting to stop.

I activated my emergency lights and sirens to conduct a traffic stop. The final rest both both vehicles came to the side of the roadway between Wilkins Street and Bay Boulevard. I provided dispatch with the vehicle's tag and my final location. Dispatch advised me that the vehicle's registered owner had a suspended Florida driver's license.

INTRODUCTION OF THE ISSUES: Police officers were called to Mr. Smith’s residency regarding a noise violation on February 4th, 2007. Officers observed the occupants, including Mr. Jonathon Blake, through the large front window of the dwelling engaged in activity that appeared to the officers as smoking marijuana. They also witnessed Mr. Blake hand over a small plastic baggie filled with suspected cocaine to another occupant. The officers were granted access to the home by Mr. Smith and noticed what appeared to be a shotgun between the couch cushions. Further inspection of the residence revealed three additional guns. Mr. Blake had a large amount of suspected marijuana and cocaine and $400 on his person. Mr. Blake is being charged with Possession of a Controlled Substance, Distribution of a Controlled Substance, and Possession of an Unregistered Firearm. It is in my professional opinion that the seized drugs are admissible to the court as evidence but the guns however, are not.…

The discovery and search are procedures affirmed by cases New York v. Belton, 453 U.S. 454, (1981), Arizona v. Gant, 566 U.S. 332, (2009) and Wyoming v. Houghton, 526 U.S. 295, (1999). In the case of New York v. Belton, the court ruled that officers can search a car and any compartments in the car after conducting an arrest. This allows the search of the vehicle in the case of Rounds, because he was in custody in the patrol car, and he was arrested. Arizona v. Gant held that the search of a vehicle, after its occupant is arrested, is permissible if it is reasonable to believe that there is evidence linked to the arrest. Since Officer Towns first arrested and placed Rounds in the patrol car and then moved to question the opaque bag, he was in his right, especially because there was reason to believe that the contents of the bag could be linked to evidence of Rounds’s past crime: possession of marijuana. The prosecution cites Wyoming v. Houghton as well. This case dictates that as long as there is probable cause to search a vehicle, all following searches, including those of its contents are legal. Since there was probable cause to search Rounds’s vehicle, the recovery and seizure of the opaque bag was constitutional.…
