Claimant Whitney Case Summary
On Sunday, February 5, 2016, Claimant Whitney stated that she was at home with her husband, as they were getting ready to go to church early that morning. She said she and her husband, Mr. Thomas Whitney had just departed from the front door of the residence and were walking towards her car parked in the front driveway when she “suddenly lost weakness in her left leg.” She said she felt weakness in her left thigh down to her left ankle, and she “felt a numbing sensation and a tingling sensation throughout her left leg.” She said the weakness and numbing sensation had immediately caused her to lose control of her balance when she collapsed and fell on her left leg as well as on her left foot, which folded underneath her buttock area. She subsequently fell on the left side of her buttock. The claimant heard a “crack come from her left foot and felt a tremendous amount of pain in her left foot.” Her husband, Mr. Whitney, assisted her up into their vehicle, and he transported her to San Antonio Hospital Emergency Room. …show more content…
Cuong Nguyen diagnosed her with a left-foot fracture after he had taken x-rays of her left foot. She said the x-rays showed that she had two fractures in her left foot. In addition to the left foot fracture, the claimant said she also experienced pain and swelling in her left foot, caused by the fracture. The claimant said her left leg was placed in a hard cast.

As of her visit to the San Antonio Emergency Room, the claimant was not admitted; however, she was placed completely off from work due to her left foot fracture injury and has not been medically released to come back to work by her follow-up physician, Dr. David Engelhardt. Furthermore, her current doctor, Dr. Singh, who is her attending physician, is assisting her with pain management for her left

    On the night of January 11, 1983, Nancy Cruzan lost control of her vehicle while traveling down Elm Road in Jasper County, Missouri. Cruzan’s vehicle had overturned, ejecting her from it, and Cruzan was discovered lying face down in a ditch. At the time of discovery, she was found to have no pulse or respirations. However, paramedics were able to restore her breathing and heartbeat at the accident site. She was then transported to the hospital in an unconscious state. The attending Neurologist diagnosed Cruzan of sustaining probable cerebral contusions stating that her upper brain, or the cerebral hemispheres, were too damaged to function. The part of the brain that controls thinking and feeling, the ability to move purposefully, compounded by a significant lack of oxygen, estimating that she was deprived of oxygen from between 12 to 14 minutes. After 3 weeks in a coma she progressed into an unconscious state, but in order to provide nutrition and fluids, with the written permission of her then husband, surgeons implanted a gastrostomy feeding and hydration tube.
