If Mary damages a client’s hair she would be held liable. According to our textbook, Mary would cause injury to the plaintiff. Mary was to provide a duty of care to the customer. She breached this duty of care “failure to exercise care or to act as reasonable person would act (Cheeseman, 2010, p. 81).” The reason I state, that is because the customer trusted Mary with their hair and she damaged the client’s hair. As long as Celia and Mary register their boutique name with the United States PTO in Washington, DC, and the PTO approved it, there should not be any legal problems. If Celia and Mary decide to offer…

The term integrity is used in the business literature to describe different leadership traits. David Bauman highlights an example of integrity's multifaceted nature provided by Bill George who is one of the most influential practitioner/writers on leadership today (Bauman, 2013). In his book Authentic Leadership George writes,…

A tort is a civil wrong or injury other than breach of contract. A court will provide a solution or action for damages. Sometimes an individual may commit what is considered an assault. A situation involved this athletic event where the tort occurred during the course of play before the whistle has blown. This behavior may result in a penalty and a suspension, but it is not compensable by means of the civil liability way. Sports such as football and basketball involve torts, and if it wasn’t lucky, it would be impossible to play the game. Therefore, everyone who participates in sport activities incur risks in the event. Some behaviors will fall outside the area of what is reasonably expected to rise as an assault and battery claim. That includes Behavior occurring after the whistle has blown that caused injury or behavior that is intentional/reckless that could not reasonably be expected to occur during the athletic event. So, there are similarities in the law between rough physical behavior and outrageous behavior that can be expected to occur during an athletic event.…

In the Final Paper (Case Study) it speaks to the following case and circumstances. Knarles and Barkley are father and son respectively. Barkley is seventeen years old. They operate a facilities maintenance company that regularly does business in the District of Columbia, Maryland and Virginia. The company is based in Maryland. They have a number of contracts with building owners where they have agreed to provide building maintenance to both residential and commercial buildings within the three jurisdictions already mentioned. They receive a monthly payment of $2,000 to $4,000 depending upon the size of the building. They bill the owners for any equipment of a substantial nature that has to be replaced. Because of Knarles long-term relationships with building owners, these contracts that were once in writing are generally renewed without a new written agreement. Often Knarles and Barkley will replace outdated and broken equipment such as water heaters and boilers that are part of a building's heating system. Further, as part of maintenance they regularly wash windows, remove snow and do touch-up painting as required.…

Arbitration means “a neutral third party or panel of experts hears a dispute and imposes a resolution of the parties” (Miller & Jentz, 2008, p.50). However, both parties must sign and agree to the above statement for it to be acknowledged as a legal judgment. In the case of Thomas Baker and Osborne Development Corporation it gets a little bit more involved. For starters, Osborne Development purchased the home warranty program administered by Home Buyers Warranty and signed the agreement of arbitration with them. However, the agreement of submitting disputes to arbitration also involved home owner and not just the builder, warranty issuers and HBW. Consequently, I don’t think the homeowners should abide by the arbitration process since they never signed the agreement papers. Thus, Thomas Baker and others could possible take the case to court because there is an issue of arbitrability, “a dispute arises as to whether the parties have agreed in an arbitration clause to submit a particular matter to arbitration” (Miller & Jentz, 2008, p.51).…

On 2 September 1818 the defendants posted an offer to sell some wool to the claimant. The offer asked for a reply by return of post. The letter containing the offer was misdirected because it was not properly addressed. It therefore arrived on 5 September, whereas if it had not been misdirected it would have arrived on 3 September. The claimant posted a letter of acceptance by return of post. This letter arrived on 9 September. If the first letter had not been misdirected, a reply by return of post would have reached the defendants by 7…

By definition under Sec 2(h) Contract Act 1950, “an agreement enforceable by law is a contract”. A contract is a promise or agreement between two or more parties that is enforced by law to be legally binding. It may involve a duty to do or refrain from doing something, and the failure to perform such duty is a breach of contract. The role of law in a contract is not to punish the breaching party but to provide remedies to restore the person wronged to the position they ought to occupy if the contract had not been breached.…
