Section 1 – Know the employment rights and responsibilities of the employee and employer

1. Identify four main points that would be included in a contract of employment. If possible, use an example contract to support your answer (feel free to obscure any confidential information).

Besides employer’s and employee’s names there must be included employer’s and employee’s expectations from each other: duties and responsibilities, hours of work, salary, holiday entitlement.

3. Identify a range of places where a person can find information on employment rights and responsibilities. You should identify at least two internal and two external sources of information.

Internal sources: line managers, books and documents held within organisation, staff association representatives External sources: legal professionals, government, educational courses

4. Describe how representative bodies can support employees.

Representative bodies can assist employees in many issues such as health and safety, pensions, TUPE, workforce agreements, collective redundancy, union learning, collective bargaining and European consultative bodies. These issues can be assisted only by Trade Union representative bodies. In some organisations may exist non-union representatives that are able to represent employees in everything what trade unions represents but they are not able to assist employees in union learning and collective bargaining.

5. Identify employer and employee responsibilities for equality and diversity in a business environment. You should give at least two employer responsibilities and two employee responsibilities.

If possible, provide relevant equality and diversity procedures from your workplace (or place of study) to support your answer. These documents should be annotated to highlight the relevant sections.

Employer is responsible to provide equality and diversity training to each of the organisation’s staff. Also he has to make sure that line manager perceives equality and diversity principles and is willing to apply this knowledge practically. Employer should also develop equality and diversity procedures in the organisation constantly.

Employee is also responsible for equality and diversity at workplace. He should be sensitive to other co-workers without judging and putting inappropriate labels. Each of organisation’s staff should be willing to learn about different people and treat everyone with a respect that he would expect from others himself.

6. Explain the benefits of making sure equality and diversity procedures are followed in a business environment. Your answer should include one benefit for the employer, one benefit for the employee and one benefit for the overall organisation.

Diversity can be really valuable from an organisation’s perspective with benefits for employer, employee and the whole organisation. When organisation treats its employees equally they get an opportunity to learn from each other and improve their skills because different people have different experiences. When employees feel treated fairly organisation creates positive work environment and employees are more willing to work efficiently. Also if organisation chooses new or promoted employees equally depending on their skills, ability to actually do the job and experience there are no damage done to organisation’s reputation and operation efficiency.
