That is one thing that can be argued that was not fair with the laws placed by Hammurabi. There were various degrees of punishments based on where you were in the social order. The people were trialed to prove their innocence or guilt but the trials were determined to be painful and dangerous. Trials for a citizen would be held just for being accused of a crime.
