Court Observation Paper
For my court observation, I was able to sit in a Texas State District Court. The judge of the court I observed was Honorable Judge Etta J. Mullin. Everything was pretty much what I expected to see. I wasn’t expecting anything outrageous to happen like on the television. I was expecting everything to be very professional and very boring, like watching the C-SPAN channel.
The walls were a dull brown color and most of the furniture was wooden. The Judge sat on a little stand and next to the stand was a seat where people would go to present evidence or tell stories under oath. On the Judge’s right side, there were two rows of seats that the Jury would sit in. There were police officer standing in the room and people sitting down in the audience like me. I couldn’t tell if they were just spectators in the audience, or family/friends of the people on trial.
When I first entered the courtroom, I walked in the middle of a court case. Most of the court cases were pretty straight forward. People pleaded guilty and the Judge moved on to the next case. The most interesting case was an assault because it was assault. The defendant of this case also pleaded guilty, but afterwards the Judge talked with the lawyer to discuss what sort of punishment or jail time he should receive. Because there were three counts of assault, the defendant was fined $40,000 and 3 years of community service. I thought it seemed fairly reasonable since the one of the victims suffered injuries such as skull fractures. I, however don’t think that I am experienced enough to know what is considered a good punishment for a crime.
Other cases were simple things, like people being caught with possession of marijuana. The penalty for that is a small fine. That reminded me of a time when a guy I knew was caught in possession of marijuana on his was to Waco. He was kept in a holding cell and I had to drive to

One of the issues facing the court system today is judges are not able to see many cases because of their administrative role. Judges spend the majority of their time “papering budgets, scheduling cases, supervising employees, and maintaining court records” (Robinson, 2009, pg. 208, para 5). The courthouse employee’s work together getting cases dispensed as quickly as possible. Some of these cases are dismissed before even being seen because of how many cases there are. Many of the minor cases are plea bargained so that the…

Although most Americans agree on what is considered to be a crime, not everyone agrees with punishments. What are common views on crimes? What are common views on punishments? Should the punishment match the crime? Should the punishment be more severe than the crime? What happens to the victim of crimes? American’s ask all these questions on a daily basis all across the United States. The majority of society in the United States says that crimes are “a grave offense especially against mortality”(“Crime”). Many say that criminals’ punishments should be equal to or more severe than the crime that was committed. Patty Hearst not only was a victim of a kidnapping in 1974, but was also brought before the court…

A judge will take into account the guidelines set forth by the State’s Penal Code, as well as those brought forward by the defense attorney. An offender’s criminal history, involvement in the crime, and the circumstances surrounding the commission of the crime will all be considered in deciding whether to hand down a harsher or more lenient punishment. An offender who is considered a first-time offender may be granted leniency or a reduced sentence, but strong arguments can be made in favor and opposition of such a practice. Finally, punishment serves multiple purposes, for the victims of crime as well as the public, and the benefit for all involved should be considered. Ultimately, the judge will review all mitigating circumstances and deliver what he or she believes to be a fair sentence for each individual…

    Philosophy Of Sentencing

Remorse for the offense and apology to the victims, court and society are greatly scrutinized and regarded in the sentencing stage of a trial, however, they are not to be used as a replacement for punishment, but may be regarded for leniency. Remorse and apologies have been ingrained into our psyche beginning in childhood, where a simple “I am sorry”, is a request for forgiveness and can mend many broken fences. For the victims involved, an apology can be the start of the healing process and closure for crimes of an intense emotional nature (Bibas & Bierschbach, 2004). Fortunately our society is not limited to just incarceration or death, but there are several options available to the court system. The sentencing authority can implement a monetary fine, community service, house arrest or even probation or time served (Schmalleger & Smykla,…

Sentencing is and has long been a crucial phase within the criminal justice process. Sentencing is what occurs post-conviction following an offender’s guilty plea or a trial by jury in which the offender is found guilty. The philosophy of sentencing is that of punishment for a crime committed. This punishment can include incarceration, rehabilitation, probation, fines, and community service. In order to prevent crime from occurring or re-occurring, a deterrent such as incarceration must exist.…

I was a bit intimated walking in due to how big the courthouse looked, but once I arrived, I went to the help desk and a police officer kindly directed me to the room I was looking for. I was a bit surprised when I walked into the courtroom regarding its size. I expected to be a lot bigger due to the media’s representation of courtrooms on TV shows and movies. The courtroom was very plan looking, but neat. When I first arrived only a few people were present and court was not yet in session. Within fifteen minutes of me arriving, the judge, Rachelle L. Harz, walked in and asked if everyone was ready, however, a juror had not yet arrived, and it took approximately ten more minutes for the juror to arrive, and then court was in session. While waiting for the juror to arrive, the plaintiff’s attorney approached me and he was very pleasant, he asked me what school I attended, what my major was and if I am considering law school. He also pointed out that Montclair State University has a very good paralegal program, which is something that I have been…

Section 718 of the Criminal Code of Canada outlines the six purposes of sentencing. The following six purposes under s. 718 are “1. to denounce unlawful conduct and the harm done to victims or to the community that is caused by unlawful conduct; 2. to deter the offender and other persons from committing offences; 3. To separate offenders from society, where necessary; 4. To assist in rehabilitating offenders; 5. to provide reparations for harm done to victims or to the community; 6. To promote a sense of responsibility” (Criminal Code, 1985). This is not the first time Mr. Custaldi has come in contact with the criminal justice system nor is this his first time being convicted of assault. Mr. Custaldi was on probation when he had committed his…
