Government and politics HW:
Arguments that suggest that parliament is all sovereign:
• Parliament is competent to pass laws on any subject;
• Parliament's laws can regulate the activities of anyone, anywhere;
• Parliament cannot bind its successors as to the content, manner and form of subsequent legislation; and
• Laws passed by Parliament cannot be challenged by the courts.
• Parliament is also free to modify its own makeup and authority
• However, as previous Parliaments decisions do not bind future Parliaments the UK can withdraw from the European Community if they so wish it
Arguments that suggest that parliament is not all sovereign:
• The European Community law has to be given primacy over domestic UK law e.g. Factortame Case
• The institutions within the European Community are allowed to make laws which the UK has to apply in its courts as long as it affects the UK regardless of whether Parliament wishes it or not.
•The EU runs our agriculture and fishing policies, has a major say in our environmental policies, runs our trade and competition policies, and some influence over almost every policy area.
Limitations of the parliament:
The European Communities Act 1972:
Directly applicable EU Law now applies in the UK and takes precedence over national law.
The Human Rights Act 1998:

The human rights situation in Belarus saw little improvement in 2013. The state suppresses virtually all forms of dissent and uses restrictive legislation and abusive practices to impede freedoms of association and assembly. Journalists are routinely harassed and subjected to arbitrary arrests and detention
