What must Hank prove to have New Will admitted to probate, and, in light of Abby’s contest, is it likely that Hank will succeed? First of all, Hank will succeed in proving the will but he must prove that the new will was properly executed and that Ginger did not lack the ability to make her new will at that time.
Because Abby’s will contest was filed before the new will is admitted into an authorization. To prove that the will was duly effected, a will proponent must prove that it was signed by the testator and also was signed by two capable witnesses over the ages of fourteen in the presence of the testator. For instance, the corroborations indicates that it was signed by Ginger in the presence of her good friends Oscar and Betsy who also signed as a witnesses. Even though unfortunately Betsy is already dead, it only takes just one witness who can testifies of these basics in the absence of an independent will and Oscar for the moment is alive. Although for Hank it will be a little bit difficult to find him because he no longer lives in Texas, the detail that Oscar was Ginger’s good friend probably means that he will voluntarily come to testify or at least sign an confession to the necessary

There is evidence under each of these facts to verify each of the requirements to prove. Ginger told her friends Oscar and Betsy that her 1/3 of her property would go to Hank as a result of her will, so this is correct since she was leaving all of her land to her brother Hank. This is clear and strong evidence that she understood the nature of her act, leave her property, and also understood the nature of her property, her inheritance.
