Lump Sum Contracts
The Lump sum contract is a fixed price contract and the purpose is to reduce the costs of design and contract administration where the contractor offers to do the whole work as shown in drawings and specification for a total agreed sum of money. This contracting technique requires the Contractor to submit a lump sum single price to complete the total project. Contractors will be provided with a set of bid documents including plans, specifications to ensure fairness and to maintain same work estimation. Agreed lump sum amount will be paid to the contractor at the end of the project completion. In large projects, part payments will be made to the contractor at different stages of the project on mutually agreed terms.

I have identified a basic contract that is used when a provider and client have agreed to a specific service and payment for service (Savetz, 2012). The contract is at the end of this paper. In my scenario, the Client has requested the Provider to complete a concrete pad in the back yard of his new home. I will analyze this contract and identify the type of contract used, whether the contract is fair, if the contract is integrated or not, if the contract allows for the assignability of rights, and if the obligator can appoint another party to perform the contractual duties. I have identified the Client as McVay, and the Provider as Thomas. Thomas is the sole owner and employee of the company Concrete 123, in Sacramento California.…

This is the step where the buyer decides whether or not to procure a part of the project. Using a project scope and project management plan, the buyer would conclude to outsource after doing a make-or-buy analysis or using expert judgment. If procurement is a result of that analysis, a procurement management plan is created. Plan Contracting: Once a procurement management plan has been created, the plan is used to prepare the necessary documents needed to solicit bidders. A contract statement of work is created and updated, a request for proposal is written, and evaluation criteria are determined. The buyer is still in planning mode. No formal interaction between buyer and potential sellers has occurred. Request Seller’s Response: In the request seller’s response step, the procurement documents, including the request for proposals, are advertised or sent to potential sellers. The buyer develops a qualified seller’s list (a short list of sorts of potential winners of the work). Select Seller: After receiving the procurement documents packages from the qualified sellers, the buyer must select a seller and award a contract. Sellers are selected using various tools and techniques, including weighted systems, screening processes, seller rating systems, and expert judgment. Negotiations between the selected seller and buyer take place before a contract is drafted…

In the case of Paula she has a legitimate reason to file charges for reinstatement or pay as long as she has some type of proof where Next Corporation compromises to give her employment. A good example will be a welcome letter, emails, or any other document that has information about her employment and duties. Luckily for her, in the state of New York a handshake deal is a legally binding document such in the case of Texaco and Pennzoil in 1984. Also, if Paula can present witnesses in court that were aware of the business or employment offer, she can enforce it just like a written contract.…

This chapter reviews the major contracting methods and the categories of contract types used by the government from a pricing standpoint. The two that I will explore in this paper are Sealed Bidding and Negotiation. Sealed bidding is used when the contracting officer decides that adequate price competition exists and that the specification or statement of work is well defined to enable offerors to bid on a fixed-price basis. On the other hand negotiation is used when sealed bidding is inappropriate, such as instances when the specification or statement of work may not be well-defined enough for offerors to bid on a fixed-price basis.…
