Legal Case Study Of Kassie's Dilemma
Kassie, broke arm on 07/08/17 went to hospital in Burlington, IA and was referred to Great River health emergency department for a fracture to right elbow. There, she was told to see an OT Specialist. Kassie made appointment for 07/11/17. Kassie went to the recommended doctor; Dr. John Randy, 5 times to be checked up on.HR of Federal Mogul had filed a medical leave on doctor’s notice. Kassie had to fill out FMLA out of own pocket but cannot pay for it. Last appointment was on 08/23/17. Was seen by a doctor and was given instructions to see a physical doctor of choosing. There, she was given an arm brace that would be taken off 08/1/17. Kassie called doctor after the appointment. Took medical absence forms to HR and filled out leave for medial …show more content…
Doc. Appointment was at 10:30am, and she received a call from before the appointment from HR of Federal Mogul saying that she needed to report to work that night or she would be fired. She asked if she could wait until after appointment. The response was “No.” Kassie asked if she could at least get some sleep as she had not slept in over 24 hours – “no.” She reported for work that night on no …show more content…
Doctor would not respond to Kassie after multiple phone calls. Doctor’s assistant called her back and sadi they had no idea as to why Federal Mogul would want her back to work. Doctor never wrote a note or returned phone calls personally to Kassie. She later found out that her doctor had been in communication with HR without her knowledge. On 08/24/17, she went to Union representative, Tony Good, to HR to request get a copies of all the medical excuses they should have received. There, she found one that was sent by her doctor, stating that Kassie “could not lift more than 10 pounds at work.” Kassie then emailed her supervisor after being called back to work that
