The issues of neglect and abuse in the foster care system is a subject you do not hear about every day. However, this is a real problem that affects millions of children living in foster care or some kind of transitional care system. 75% of children in foster care prior to leaving the system will have experienced sexual abuse (Sexual Abuse: An epidemic in Foster Care Settings). According to the U.S. Department of Health and Human Services, nearly 475,000 U.S. youth reside in foster care, close to 30,000 leaves the system annually (Braciszewski & Stout, 2012). Research shows that 1.5 million children in America live in families that have experience domestic violence and 7 million of them live in families that have experienced some severe form of domestic violence (Ogbonnaya, 2012). CCIB received CPS referral #0972-4764-8677-3023697 from reporting party (RP) stating that on 5/15/17, foster child (FC) Destiny Salazar (age 18, DOB: 04/30/99) contacted RP to report that she was kicked out of the foster home by Foster mother (FM) for getting home late the prior evening. My grandmother encountered various forms of child fostering in her life. Kwun grew up with a distant cousin her parents took in after his parents died, leaving him orphaned at age eight. She adopted her oldest child, a victim of attempted infanticide, who was abandoned on the streets. In Asian societies, infanticide is a common practice for families who desire sons in order to pass down their family wealth. Kwun also simultaneously raised her sister’s daughter along with five of her own children when her sister and her sister’s husband relocated to Hong Kong. Many people are misinformed when it comes to foster care and its issues and successes. To be able to understand foster care one must be able to understand the process. It begins with the child’s biological parents. A child can be withdrawn for abuse or neglect, or the child can have a minor misdemeanor(s) against them and can be placed in foster care rather than juvenile detention. A call by the Child Welfare Services is then made to the foster families in the counties and surrounding counties. Then call includes the child’s age, sex and, sometimes the reasoning of withdrawal. The parents then say whether or not they will take the child(ren) into their home. If yes, the child is moved to the home until further notice if no, the calls continue. However since there is no law in place for such people, they are required to follow a cumbersome process by first taking the guardianship of the child from the courts under the Guardians and Wards Act, 1890 and then giving due assurance to the Court that they would legally adopt the child as per the laws of their country within two years of their arrival there. All this can be avoided by bringing a law in place which will deal with all such cases and consequentially the misuse of adoptees will also come down. Newspapers have reported a number of cases where the child has gone to an alien land only to be mistreated. Such children have been used as domestic servants, beggars and even for prostitution. The Andhra Pradesh scandals illustrate the wide gap between the laws of inter-country adoption and the actual practices.
