Limitations and constraints on marketing activities
Task 1
Read each of the examples of marketing activities that might be carried out by business in the table below. For each example suggest a law that the business might be breaking and the reason why.
Example
Possible legislation being broken and why
A picture on the packaging that shows better quality ingredients than those used in the product.
Consumer Protection from Unfair Trading Regulations 2008. The business is putting dishonest ingredients which show the better ingredients compared to the original one.
Passing on electronic details to a third party without obtaining consent.
Data Protection Act 1998. The business is secretly sharing its consumer details to the third parties without any permission.
Changing the interest rate on a credit card without notifying the cardholder.
Consumer Credit Act 1974 and 2006. On this law, consumers has to know the details of the transaction, by changing the interest rates without notifying the consumers, the business is breaking the law.
Advertising that states, ‘Using this product will increase your lifespan by 10 years’.
Sale of Goods Act 1979. The Product may increase the lifespan of someone, however it is not guaranteed to increase by 10 years
A pub selling pints of beer that are short of being a pint.

A supermarket selling bread that is out of date.
Consumer Protection from Unfair Trading Regulations 2008. Because the firm is manipulating the expiring date and sell it to the consumers.
Terminating a credit card agreement without due notice.
Consumer Credit Act 1974 and 2006. Because the company is terminating the Credit Card agreement without notifying the consumers about the condition.
A television advert stating untruths about a rival company.
Advertising Standards Authority. It is because the business has mocking the other company’s product and comparing to their products
Denying an individual access to information about them held on a database.
