Performing tax research is an important part of tax practice. As outlined in Chapter 2 of your textbook, tax law is developed through a number of different governmental entities. Congress enacts the tax Code as statutory law. The Treasury Department is tasked with the implementation of the tax Code and, in the course of doing so, develops a number of documents and materials to aid taxpayers in understanding the Treasury Department's interpretation of the code, including the Regulations. In turn, the Internal Revenue Service
("IRS”) has the direct responsibility for implementing the tax Code and in assessing and collecting the applicable tax from taxpayers. In the course of its duties, it also develops a number of materials, including Revenue Rulings, Revenue Procedures, and Private Letter
Rulings, in which it sets forth its understanding of the tax laws. Finally, the federal courts decide tax cases in which taxpayers contest the government's interpretation of the tax laws. In deciding these cases, the federal courts set forth binding interpretation of what the tax laws
provide.

The following cases demonstrate instances when the United States Tax Court granted substantial compliance to taxpayers who did not meet all of the statutory requirements to receive the exemption. In Bond v. Comm’r, the taxpayer failed to attach a qualified appraisal to his income tax return, rather than a full appraisal. The Tax Court found that the taxpayer substantially complied with the statutory requirements to receive a charitable contribution deduction because “the substance or essence of whether the charitable contribution was made” fulfilled the legislative purpose. Bond v. Comm’r, 100 T.C. 32…

I chose this court case because the decision will have effects on many businesses in the United States who own foreign companies. A holding for the Commissioner of Internal Revenue may subject taxpayers in PPL’s position to double taxation. However, a holding for PPL threatens to undermine the consistency and uniformity of the U.S. tax code as well as curtailing the power of the Commissioner of Internal Revenue to interpret the law.…

The Internal Revenue Code, Title 26 of United States Code, was first created in 1939 and was redefined in 1954. Changes made to the IRC replace old information so it is always currently defined what the laws are. This is the main source of tax law. Treasury Regulations are decisions made which can illustrate the IRC. There are proposed, temporary, and final regulations. Proposed regulations are proposed but not made final, temporary regulations are the process of making a proposal final, and have less authoritative weight, than final regulations which are the final regulation. If laws are undetermined by the IRC and the Treasury Department hearings go to court. U.S. Tax Court, U.S. Court of Federal Claims and U.S district courts are the choices of presenting litigation in which laws are interpreted…
