TATA MOTORS CASE
Tata Motors in Singhur case talks about the controversy related to Land acquisition by Chief Minister Buddhadeb Bhattacharya for proposed Nano factory in West Bengal. The reason for choosing West Bengal as the location was that it was believed as the most investor friendly state with faith in investment climate and government of Bengal. However, soon after the announcement of the Nano Project, the protest led by opposition leader Mamta Banerjee began as it was viewed as forcible acquisition of Land. Should the government acquire Private Property for Public purpose?
With continuous increase in population and technology advancement, the need for property increases. Also, the government initiative to spur employment in the manufacturing and service sectors also increases the need for Private property to be used for public purposes.
As per the new Land Acquisition Bill 2013, Private property can be legally acquired by the government for its own use,transferring it to private companies for stated public purposes and direct use by private companies for public purposes.
However while making the choice for Private properties being used for public purposes, the following points should be considered:
Proper compensation should be provided to public depending on the market price of
Property. Tata offered compensation to 13000 farmers in 2007 at the market rates of $17000 and $ 24000 per acre for single crop and double crop land, respectively
Instead of acquiring fertile land, government should go for less fertile land so that it doesn’t affect cultivation
Keeping the long term view in mind, employees should be provided with alternative job opportunities so that their livelihood remain unaffected
Ensure that the acquired land is used for public purposes and helps in providing employment to people
In order to avoid resistance, assurance should be given to public with respect to their property or compensation paid

    In the Unites States the Fifth Amendment of the US Constitution imposes limitations on the exercise of eminent domain. In a landmark eminent domain case that was presented to the US Supreme Court in 2005, the limitations have been greatly expanded giving the federal, state and local government the ability to take private land and then sell it to private developers. Eminent domain has always been a tool at the government’s disposal and was used to establish things like the transcontinental railroad. Eminent domain, as described by the Constitution, states that the government must use the land for public use. The public uses clause has been broadened over the years. The United States is not the only country that allows for eminent domain, although called different things the principals are the same. Countries such as the United Kingdom, Ireland, Australia, Canada, South Africa, etc. all allow for land to be taken for “the greater good”. The laws and protections vary greatly. I plan to look at some of the benefits of Eminent Domain as well as the many downsides of eminent domain. I will explore several sovereign nations and how eminent domain has helped and hindered growth, private property rights, and the true cost of exercising eminent domain.
