This investigation initiated on 1-3-16 at approximately 10:19 AM when Officer Leeds of IMPD was dispatched to the Kroger grocery store located at 4202 S East St in Marion County on a person shot run. Leeds was approaching the area when he observed the victim running east bound across US 31. The victim, who was later positively identified by police as Jason Reed W/M, DOB 9/23/79, was attempting to flag down Officer Leeds, and Leeds observed that he was bleeding. Officer Leeds spoke to Reed at the end of his driveway at 516 E Mills Ave, Marion County, Indianapolis Indiana. Reed explained to Officer Leeds that someone had broken into his house and shot him in his hand and showed it to Officer Leeds. Reed said that he was concerned

When they walked to the back door of the residence Leeds observed that the door was open. Reed entered the residence into the kitchen, and Leeds, who was in the doorway, observed a dog laying on the floor bleeding. Officer Amanda Gomez arrived on scene to assist and while talking to Reed, they observed digital scales and what they believed to be marijuana on the kitchen countertop in plain view. They also smelled what they believed to be, based on their training and experience, the odor of fresh marijuana. Medics arrived on scene and the victim was transported for treatment. Due to the nature of the call a protective sweep of the residence Officers Leeds, Amanda Gomez and Alfredo Gomez observed more of what they believed to be marijuana on a coffee table in the living room. They also observed a handgun on the TV stand and a rifle laying on the floor next to the couch in the living room. Officer Leeds graduated from the ILEA training academy. Amanda Gomez and Alfredo Gomez both graduated from the IPD training academy. They have all been trained to recognize the appearance and odor of marijuana and it was immediately apparent to them that they observed and smelled fresh marijuana inside the residence. Officer Alfredo Gomez found suspected marijuana on the coffee table in the living room (HSE #3). Detective Trimble found a plastic bag containing suspected marijuana in the top dresser drawer in the south bedroom (HSE #4). Detective Harpe found suspected marijuana inside a box on top of the dresser located on the south wall of the south bedroom (HSE #5). He also found a bottle of suspected liquid Tussionex and a pipe on top of the nightstand in the south bedroom (HSE #6). Detective Harpe also found a bottle of miscellaneous tablets, a plastic baggie containing suspected marijuana and a plastic baggie containing green powder in the top nightstand drawer in the south bedroom (HSE #7). Detective Schweers found suspected marijuana and a pipe on a table in the north bedroom (HSE #8). He also found plastic bags containing suspected marijuana inside a bucket in the north bedroom (HSE #9). Detective Harpe found a plastic bag containing suspected "candy" THC inside the microwave in the kitchen (HSE #10). He also found five plastic bags containing suspected marijuana in a laundry basket on the floor by the nightstand in the south bedroom (Item #11).     This case can similarly be connected to the Draper v. United States 358 U.S. 307 (1958). In the Draper case, the arresting officer had probable cause to arrest petitioner without a warrant and that the follow-up search and seizure was lawful. In the case of Joe Thug, both the officers went to check the reported scene of abuse without a warrant. Since the officers had probable cause they were able to go to Ms. Smith’s residence without one and were granted permission to enter the home. Due to Ms. Smith’s compliance, the officers were allowed to enter the home and proceed with the investigation. While constructing the search the officer notices burns on Sam’s arm which leads him right behind Joe. When the officer enters the bedroom after Joe, he smells marijuana and those to pieces of evidence was enough indication that something unlawful was occurring which led to the follow-up search and seizure. Likewise, in the Draper case, the informant had prior experience working with the police which increased his credibility and reliability. The informant was also able to give a specific address of where the narcotic would be found. In the Ms. Smith case the informer also had worthy credibility because she was not getting paid for her services nor had anything to gain by telling the officers.
