“Ohio Amish girl ordered to resume chemotherapy despite pleas of parents”

Akron Children’s hospital can now force a child who is Amish and only ten years old to resume chemo after her parents decided to stop the treatment. The court wrote in its ruling, “Parental rights, even if based upon firm and honest convictions can be limited in order to protect the ‘best interests’ of the child.” This decision came from an appeals court after two previous judges ruled in favor of the parent’s decision and not the hospital.
The hospital asked the judge to appoint a medical guardian for the girl after the parents stopped treatment. Lawyer and former nurse Maria Schimer is being appointed this child’s medical guardian.
I do not agree with the parent’s decision to take this child off of chemotherapy. However, this is their choice not the doctors, hospitals, or the governments. This should be a decision made only by this child’s family and child. So long as the parents are in their right state of mind (Ex: not mentally unstable, hooked on drugs, etc.). This family has worked with the hospital the last two years and they feel the child has endured enough. These parents want to try “natural medicines” after the child’s first dose of chemotherapy. Why are the parents not allowed to try this?
This is just another example of how our rights are being slowly taken away from the people who reside in the United States. The government is stepping in where they have no business. This is not a case of unfit parents, this is a case of religious beliefs and rights. This is an Amish family who obviously cares about their daughter or they wouldn’t have taken her to the hospital in the first place. I think that hospital has taken this too far no matter what they think.
Why is the government stepping in? Why now does this child have three people telling her what is best for her? The person who is now is appointed guardian is not only a lawyer, but is a former nurse;

She said that she has a cousin that is an emergency room doctor who looked at the chart and said that they did something wrong by releasing him and I’m not sure I understood her story, but I would need to drill Ben a little more with her there, but he seemed to think they should have released the father without some anti-clotting medication and/or a filter.…

    This case study describes an eight month old child in the emergency department with bilateral femur fractures. It presents several ethical issues. The first ethical issue would be the possibility of child abuse by the mother or the day care. Second, the mother waited several hours before seeking care for her child and made no mention of the child’s thighs. The mother reported the child crying constantly for the last several hours, but did not mention looking to see what may have been the cause. The nurse expressed concern that the child may have been injured; however, made no effort to follow up. A case worker, social worker, or proper agency was not consulted. The physician stated that he felt it was not child abuse so he did not report it. Health care workers are governed by law to report suspected abuse to the proper authorities (Fraser, J. A., Mathews, B., & Walsh, K., 2009).…

    New York’s Family Health Care Decision Making Act (FHCDA) “establishes the authority of a patient’s family member or close friend to make health care decisions for the patient in cases where the patient lacks decisional capacity and did not leave prior instructions or appoint a health care agent. This “surrogate” decision maker would also be empowered to direct the withdrawal or withholding of life-sustaining treatment when standards set forth in the statute are satisfied.” (http://www.nysba.org/Content/NavigationMenu/PublicResources/FamilyHealthCareDecisionsActInformationCenter/FHCDARC.htm) With Mr. Bevins being the appointed guardian, it gives him the right to make the decisions on his wife’s behalf. Since there is uncertainty as to whether Lydia can make her own decisions, the doctors would have to confirm that Lydia is no longer capable of making…

    No, I do not feel the little girl is receiving adequate care, In order for her to receive adequate care I think when she was admitted into the emergency room, the staff that dealt with her should have given her a prescription for an asthma inhaler to control her symptoms and prevent any future debilitating episodes. But as the child’s parents do not currently have a healthcare provider this option wasn’t thought of or considered which is why a believe she was not receiving adequate care.…

    In Michigan (my home state), a guardian is appointed by the court. The guardian becomes the point of contact for the patient and they make all of the decisions concerning their care if the patient if they are deemed mentally incompetent. Therefore, in the unfortunate event of an acquisition (Option 1), the court appointed guardian would be contacted to discuss the issue of moving with the patient. However, in my facility, I would do everything possible to ensure that the patient is placed in another nursing home that offers quality service. Moreover, I would make arrangements to have a discussion with my patient’s power of attorney as a caregiver who cares about the integrity and well being of her…

    The article I decided to do is from the New York Daily News. It is on the topic of Gay Marriage and its title is “Five arguments against gay marriage: Society must brace for corrosive change.” In this article there are different areas of concern that the author talks about. One is religious freedom. The Author Wrote “A recent Newsday editorial said opponents “will be seen by future generations in much the same light as those who opposed school desegregation. Devout Catholics, Orthodox Jews and, ironically, the 70% of African-Americans who oppose gay marriage will become the new Ku Klux Klan?” (Forman, 2011) I disagree with this, there is no such thing as traditional marriage. Given the prevalence of modern and ancient examples of family arrangements based on polygamy, communal child-rearing, the use of concubines and mistresses and the commonality of prostitution, heterosexual monogamy can be considered "unnatural” in evolutionary terms. (Pro & Con Arguments: "Should gay marriage be legal?" 2011) The second argument is the Rights of Children. In the article the author says “More children living in gay homes means more children living lives absent a relationship with at least one biological parent. This will result in some emotional pain and confusion”. A study published in Pediatrics on June 7, 2010 found that children of lesbian mothers were rated higher than children of heterosexual parents in social and academic competence and had fewer social problems. And a July 2010 study found that children of gay fathers were "as well-adjusted as those adopted by heterosexual parents.” (Pro & Con Arguments: "Should gay marriage be legal?" 2011).The third argument concerns traditional marriage. “Eliminating the complementarily of the sexes in marriage changes its essence. It may be old-fashioned to believe women are still necessary to domesticate sexually predatory men. But…
