The New York and Presbyterian Hospital (NYP) is a leading provider of inpatient, ambulatory, and preventive care services in and around New York City. NYP is one of the nation’s largest health care facility that has over 2 million patient visits, about 15,000 births, and processes over 310,000 emergency room patients every year. This hospital, ranked #1 by U.S. News and World Report, has six campuses, including two that are affiliated with medical schools. NYP has approximately 2,600 beds and employs more than 26,500 staff members, including 6,500 physicians, spread across these six campuses. NYP’s East 68th Street campus is affiliated with Cornell University’s Weill Cornell Medical College (CORNU) and known as NewYork-Presbyterian / Weill Cornell Medical Center. The West 168th Street campus is affiliated with Columbia University’s College of Physicians and Surgeons (CU) and known as NewYork-Presbyterian / Columbia University Medical Center. As a result of this agreement, both entities have created a shared data network that allows CU Doctors access to patient information systems containing Electronic Patient Health Information (ePHI) across both campuses using a shared firewall. Employees of both entities administer both, the shared network and the shared firewall. In September of 2010, NYP and CU submitted a joint report to The U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) revealing the breach of ePHI records. This report stated that ePHI records of 6,800 patrons were disclosed to the internet search engines.     Prior to the enactment of the Health Insurance Portability and Accountability Act (HIPPA) health information was able to be shared without the knowledge or permission of the patient. This information was available to just about anyone including insurance agencies, places of employment and even loan lenders. People would potentially use individuals’ health information to deny them work or a loan for their home and even impacting higher insurance rates or denial of coverage.     The Health Insurance Portability and Accountability Act (HIPAA) was passed in 1996. The main purpose of this law was to improve the flow of health information. At this time, the great majority of the records were still in paper form, however there was a push for the healthcare industry to become digital. Prior to 1996, the only federal law that regulated the privacy of health information was the Privacy Act of 1974. Between 2003 and 2005, there were more than 13,000 privacy complaints, but no civil enforcement actions were brought by the HHS Office for Civil Rights (OCR). In that same period, there was only one HIPAA criminal action, against a lab assistant who used the personal data of a terminal cancer patient for identity theft. By 2008, 33,000 + complaints had been filed with OCR, only about 8,000 were investigated with 5,600 leading to corrective action, yet no fines had been issued.
