Murder Case Justified By Necessity
For this case the main question here is was this murder case justified by necessity. The verdict I have come up with is that that both men are found guilty of murder but face a lesser charge of five years of jail time. I decides on this verdict because they needed to do it or everyone would die. Also Parker looked very sick and according to them he was on the verge of dying. The crew members were also starving and if they didn't act they would have all died. They deserve they five years for murder but should not be executed because they had to do it in order to survive. It's also important to take in consideration that Parker did bro want to be killed and was being held down by Stephens and was killed by Dudley. When someone is trapped on a

At present in English legal system there are two homicide offences murder and manslaughter. For the most serious, murder proof of an intention to kill or cause serious harm is needed for a successful conviction. If a partial defence is used in circumstances, such as provocation or diminished responsibility, then the offence is one of voluntary manslaughter. However, if someone kills but did not intend to cause death or serious harm but there was a death then they are liable to be convicted of involuntary manslaughter. There are numerous criticisms attached to Involuntary manslaughter as it covers a wide range of behaviour which can cause death, although one of the most prosecuted common law offences it is not yet become subject to any statutory definition or change and is in need of reform.…

Introduction: The insanity defense has been used for many years and believed to began around the 1720’s where the first formal defense was used in a court in 1724. Judge Tracy, the judge that ruled over the first case coined a term “The wild beast standard” that states “for someone to be insane he must be totally deprived of his understanding and memory, and not know what he is doing anymore than an infant, a brute, or a wild beast” (Neville, 2010, pp.3-4). After the Daniel M’Naghten case, a man who attempted to kill a prime minister due to his belief that the prime minister was conspiring against him ended up killing the secretary, there was a new rule many states began to follow. After M’Naghten was found insane by multiple experts because he was unable to know the difference of right and wrong therefore he was acquitted of all charges (Neville, 2010, p. 5) a rule was developed labeled after M’Naghten.…

    Rubout Argument Analysis

Here, we must answer both possibilities with an if-then argument. If (1) was true, then constitution-wise, it’s unquestionably wrong. This one can go a long way. First, the judge didn’t ask for their opinion for justice. In fact, the two we’re still going to have a trial. And by the new law—the death sentence has been, so to speak, rubbed-out. For if they killed the two for moral reasons like vigilantes would reason-out, then again it’s still wrong for no one has the right to put the law in his/her own hands.…

There are not many absolute truths in the world. Almost every point can be argued and justified. But if there is one truth universally recognized, one truth upon which societies the world over have been based on, it is that murder is wrong. The willful termination of a life is immoral. If we as a society accept that to be true, how then can we condone the death penalty? How is government sanctioned murder a moral option? The legal system is not fool proof, nothing man-made is. How then can we claim that an imperfect court of law, pervious to human error and persuasion, has the power to lay down the most perfectly irreversible solution of them all: death. Even after the appellate courts have been exhausted, it is possible for an innocent person to be convicted of a crime they did not do. If there is even that small possibility, how can we, in all good conscious, make it legal to put someone to…

I am arguing the Defence and I’m seeking the verdict of not guilty. The Defence of Necessity clearly states three points. The first one being that there must be an urgent situation of clear and imminent peril. The second one being that the accused must have had no reasonable legal alternative to breaking the law. The last one states that the harm inflicted by the accused must be proportional to the harm avoided by the accused. Tom Dudley, Richard Parker, Edmund Brooks and Edwin Stephens had managed to escape the wreck by setting sail on a wooden boat that was constructed poorly and was not equipped with the basic necessities to survive. Abortion is murder of an innocent unborn baby. It is murder at any stage in my opinion. People think that when you get pregnant, the "baby" isn’t really anything until a certain point in the pregnancy. If this is true, then what is it? Whatever it is to some people, in reality, it is a baby developing. If someone decided not to abort a pregnancy, it would turn into a human being.
