The type of employment relationship that exists between an employer and employee or independent contractor is majorly based on the type of control exercised over a person and the terms agreed upon. In the case of the massage therapist hired by Dream Massage, for instance, the employee taken on-board qualities of both an employee and an independent contractor. This is based on the terms of contract laid out, where some are opposing to the idea of being an independent contractor while others support it. First of all, the employer dictates the schedule within which the therapist works. An independent contractor would have a flexible schedule where the person is in control of the hours of employment. In this case, she is an independent contractor. She gets to use her independently obtained products and clients for carrying out massages (Mattel, Fink & C.I.A, 2016). She has the freedom of choosing the clients she works with. Another point that qualifies her as an independent contractor is that she exercises complete control over how she does her work. She works based on her authority as well as without any assistance from the employer.
Receiving no tax withholding or employment compensation benefits qualifies the massage therapist as an independent contractor. If she was to receive tax withholding or compensation employment benefits, then this would qualify her as an employee. Finally, the employer having control over her rights to dress is regarded as discriminatory and out of the terms agreed in an independent contractor’s contract. There are several ethical considerations when it comes to dressing in the workplace. It helps to ensure an environment free from any distractions.
