Conflict Theory: People Are Not Fitting In With Society
Conflict theory would explain the percentages based on the idea that it is the people that are not fitting in with society. The reason that the over all white population is lower then black is because society sees them fitting in better then minority groups. The terry says that the problem lies with the person and not the over all system so black are going against the system more then whites. If they have a bad experience growing up and do not get socialized they have a greater rate of going to prison over another ethnic group.

The way that order theory would explain this is that the over all system is wrong. There has to be some kind of flaw or bias in the system to explain why blacks have the highest rates of the 3 groups listed. From the

    According to bureau of statistics for the US department of justice (2007), the number of inmates in federal and state prisons increased to more than 1.5 million between 2005 and 2006 (U.S Department of Justice 2007). (Is this a Quote? There are not Quotation marks?) Out of this population, 35% were African-Americans, despite the fact that they represented only about 12.4% of the nation’s total population. According to the national council on crime and delinquency (2009), African Americans make up 28% of all arrests made in the country, 40% of the inmates and about 42% of the population of prisoners on death row (U.S Department of Justice 2007). (Again are these quotes?) This is in contrast with the whites who make up around 68% of the total population, and a surprising 71% of the total arrests (U.S Department of Justice 2007). Yet, whites make up only about 40% of the population of inmates in federal and local prisons and around 55% of the population of inmates on death row. These facts clearly indicate an over-representation of the African American people in the US prison system. Some of the reasons that drive this phenomenon include discrimination in the American justice system, the education system and the effect of stereotypic nature of the police, the judicial system and the society in general that holds on to the belief that African Americans, especially males, are more likely to commit some felony than any other group in the US. These issues are present in the UK prison and judicial systems, where some minority groups such as the Blacks and Asians suffer the risk of experiencing some…

    Today’s incarcerated youth is made up by two-fifths African-American and one fifth Hispanic. Today’s minority youth are facing stricter punishment than their white counterparts, resulting in a larger number of minority youth jailed. The article, “Preliminary Report on Race and Washington’s Criminal Justice System” (Anonymous, 2012), states that “African-Americans are over represented in the prison population because they commit a disproportionate number of crimes”. This seems to be an unfair judgment due to the fact that minorities are more than two times more likely to be searched or stopped for any kind of criminal activity based on the color of their skin. For example, “among felony drug offenders, black defendants were 62% more likely to be sentenced to prison than similarly situated white defendants.” (Anonymous, 2012) Also once convicted, African-Americans were 21% more likely to receive harsher punishment compared to white offenders with a sentence that is 10% longer than white offenders that committed similar offences. Racism in our judicial system are present at different stages of our criminal justice system including but not limited to arrest, charging, conviction, and imprisonment.
