Bohm and Haley describe these processes as: once the jury is seated / sworn in and the criminal complaint read, the prosecution begins with opening statements outlining his/her case. This is followed by the defense presenting their opening statements also. The prosecution submits evidence supporting his case and questions it’s witnesses attempting to establish beyond a reasonable doubt the elements presented for the commission of the crime. If the defense feels the prosecution has failed to prove its case, the defense will choose to rest or not offer defense against the charge making a motion for dismissal. However if no dismissal is granted, the prosecutor and defense alternately offer rebuttals to the others evidence, cross-examining witnesses
