Alfredo Tupaz Gerona, Accused. x----------------------------------------------x Affidavit of Desistance

I, Susan Pascual Pigar, of legal age, Filipino, married with the office address at 261 Kabatuhan Road, Deparo, Caloocan City, after having been duly sworn to in accordance with the law, hereby depose and say:

1. That I am the duly authorized representative of IFP Manufacturing corporation who filed the above case for and in behalf of the corporation as evidenced by a Board Resolution passed on July 1, 2010, embodied in the Minutes of the Special Meeting of the Board of Directors of IFP Manufacturing Corporation, a copy of which is already a part of the Court Record;

2. That the same corporation likewise authorizes me to enter into a Compromise Agreement; to sign and endorse any and all the documents for the early termination of the above case; a copy of the Secretary’s Certificate is attached hereto and marked as Annex “A” hereof;

3. That the above case was filed in court when our company IFP Manufacturing Corporation came to its knowledge that the accused doing business under the name and style of Bon Bon Food Products was manufacturing and selling products seemingly similar to that of the products of our company with the trademark Lumpia Shanghai Snack Food;

4. That our company was of the impression that the accused was producing the subject products intentionally and in bad faith by instantly concluding that the accused was well aware that the trademark Lumpia Shanghai Snack Food was duly patented under IFP Manufacturing Corporation;

5. That above-said conclusion was hastily done without much thought and thorough contemplation that may have resulted to the
