QUESTION 1 "A buyer in a CIF contract has easier responsibilities as compared to a buyer in an FOB contract". With reference to decided cases, discuss whether this statement is true or not. (25 marks)

QUESTION 2 Amat Bijak Co ("ABC") contracted to supply 500,000 barrels of palm oil to Xtra Yard Co ("XYC") CIF Cardiff. It was agreed between the parties that property in goods would pass upon transfer of documents. While loading the goods on board the ship, 50 barrels were damaged and the contents spilled out. Upon receipt of the documents, XYC discovered that 10,000 barrels contained coconut oil and not palm oil. XYC refused to make payment as the goods did not comply with the contractual description. ABC insisted being paid as property in goods had already passed to XYC. Advise the parties as to their liability in the contract. (25 marks)
