Sandigan throws out DepEd director case

THE anti-graft court Sandiganbayan dismissed the case of a former Department of Education (DepEd) regional director and a regional accountant because of lack of evidence and jurisdiction.The Sandiganbayan First Division scrapped the cases of former chief of DepEd Region IX Ibrahim Albar and regional accountant Edwin Romero.
Albar and Romero were charged of violating the Government Service and Insurance System (GSIS) Act of 1997 and the Home Development Mutual Fund Law (Pag-IBIG) of 1980 for allegedly withholding the GSIS and Pag-IBIG monthly contributions and loan amortizations of DepEd Basilan Schools Division employees, amounting to P51.59 million spanning October 2002 to June 2004.However, after a re-investigation the Office of the Ombudsman flip-flopped and “found no probable cause to hold accused Albar responsible for the charges.” The prosecution found out that it was Olivia San Pablo, chief accountant of the Accounting Division of DepEd-Central Office in Pasig City (Metro Manila), who “had claimed responsibility” for the remittance of all deductions made against the teachers.Lolificacion de Ramos confirmed the findings and said that starting October 2002, the Basilan Schools Division master list of deductions was sent to the DepEd-Cotabato City and not to Zamboanga City, where Albar holds office. “Considering, however, the positive showing that the responsibility for remitting these funds was lodged with the the DepEd-[Cotabato City] and not with DepEd-[Zamboanga City] . . . Albar could not be held responsible or such remittances,” the ruling read which said the dismissal was “only proper.” As for Romero, his case was dismissed because his salary grade was only at level 15. Sandiganbayan is hearing only cases where the principal accused has a salary grade of 27 and higher.     Breaking down the first case of Stew Starr at Caldwellia High School his provocative web page advocating the recreational use of illegal drugs by students was clearly something that did not belong in the educational environment. In the landmark decision of 1969, the U.S. Supreme Court in Tinker v. Des Moines Independent Community School District declared that students “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.” Although Stew Starr’s website and statement are recognized under the freedom of speech law it does not induce or maintain an appropriate environment for learning and safety. In order for this to be upheld, although not covered by the law, some of the best practices that school officials can partake in is to adopt policies that are legally and educationally aligned to ensure the educational purpose. Furthermore these policies should be clearly written, communicated, and enforced in a fair and legal manner. In the next situation, Stew Starr threatens fellow student Clark Clean after Clark Clean states his negative sentiments towards the website. Disciplinary action should be enforced for the threat and even more so for the attack on Clark Cleans physical person. He further continues to induce violence and humiliation when he dumped the lunch tray on his head. Those are immediate grounds for disciplinary action for engaging in behavior that is dangerous and offensive according to school policies. With regard to Terry Teacher’s comment, “Stew Starr is a miserable student who does nothing but cause problems to everybody in the school.” Although unprofessional and unnecessary in the educational setting, the teacher’s statement would have been upheld by the law based off the case Pickering v.     Facts: In 1965 a Contract of Sales Agent was entered by the Association of Anglo-American Tobacco Corporation with Andres Lao. Lao was to sell cigarettes manufactured and shipped by the Corporation to his address in Tacloban, and he would remit the sales proceeds. Lao would receive commission for those sold, with a monthly salary and operational allowance. In 1968 Lao’s attention was called to his enormous accounts and the difficulty in obtaining a tally despite his avowal of regular remittance of collections. In 1969 it was established that his liability amounted to P525,053. Also, the Corp. discovered that Lao was engaged in a construction business and suspecting that he diverted the sale proceeds to such business, it gave a demand letter for payment of his obligations. It also found that contrary to his allegations, he did not have a huge collectible from customers and nothing was due to the Corporation. From then on, the Corp. no longer sent him shipments. In 1970, Andres, Jose and Tomas Lao brought a complaint for accounting and damages against the Corp.. The court ordered both to undergo a court supervised accounting but also ordered the Corporation to pay the Lao’s actual loss of earnings, moral damages, exemplary damages, atty. fees and cost of suit. Later the court gave a supplemental decision dismissing Lao’s claim of overpayment. The Corp. and the Lao’s appealed. The CA found the Corp. liable for actual damages of loss of earnings, moral damages and exemplary damages. It also ordered the Corp. to pay the claim of overpayment by Lao. It guarantees civil liberties such that all Indians can lead their lives in peace and harmony as citizens of India.
