Workplace Drug Testing
Drug testing within the workplace has become a common practice over the past three decades. While employers continue to focus on eliminating the risks that are associated with drug use from their workplace many other areas are just realizing that drug testing is important. One such area is through workforce development and training. Focusing solely on Indiana, drug testing was implemented for all new individuals who were enrolled in training provided by the Workforce Investment Act of 1998 on July 1, 2011. Individuals receiving this training were now subject to drug testing prior to starting the training process. The training being provided is funded through public funding and tax dollars. While there are many arguments that can be made for this topic the main positions are that you are either for or are against drug testing being implemented as part of the process of receiving the training required to enter back into the workforce. Depending on the side of the fence your stance is on will impact how the traditional versus controversial positions are conceived and viewed. However, for this case the personal …show more content…
According to Department of Workforce Development (DWD) Commissioner Mark W. Emerson, there is a portion of the workers who had completed the job training that were in fact not being hired due to the fact that failed the pre-employment drug tests. Everson, also states that the government should not be spending money to train people if they are suing controlled substances and will not be able to get a job. While the fact a drug test may not eliminate this from happening 100 percent it does increase the likelihood that is a more isolated event as individuals receiving training will understand that they can be tested at any

    Another case that addresses drug testing is Aubrey v. School Board of Lafayette Parish (1998). In this case we are looking at the Fourth Amendment rights of employees. Aubrey was a custodian at an elementary school. In December 1992 the board adopted an Employee Drug Testing Policy stating all "safety sensitive" employees are subject to random selection and drug testing each year. In August of 1993, Aubrey attended and in-service where the y policy was dispersed and reviewed. On September 28, 1994, Aubrey and fourteen other employees undergo drug testing through urinalysis screening. Aubrey tested positive for a chemical that is known to be found in marijuana.
