This case study is a prime example of the ethical decisions nurses come face to face with on a daily bases. Not only must nurses provide safe and excellent patient care but they must also practice under the ANA Code of Ethics and under their state regulations. When a difficult decision arises, such as in this case study, it is important to fully understand the nurse’s scope of practice to help assist in making the most appropriate decision relating to patient care. Florida Board of Nursing, Nurse Practice Act (2007) states, “Violating the confidentiality of information of knowledge concerning a patient”. In this case study, there are two main examples of violating patient confidentiality. The nurse in this case study violated patient confidentiality when she was in the cafeteria and spoke with her colleagues about the patient and the extenuating circumstances regarding the case. Another clear violation of this regulation is seen when the doctor was speaking with the niece regarding the care for her uncle in the waiting room where other people could easily overhear the discussion. The nurse did not safeguard patient confidentiality at this time. The nurse should have directed the niece and the doctor to a private room where they could privately discuss the situation. According to Florida Board of Nursing, Nurse Practice Act, the nurse can be fined up two-hundred and fifty dollars and placed on probation for the first offense. The second offense, the nurse can be fined five-hundred dollars, placed on probation and have a possibility of having his/her license revoked. Safeguarding patient confidentiality is one extremely important aspect in the nursing profession.As a nurse it is our responsibility to act as our patient’s advocate.
