A Civil Action

FACTS:
This movie, A Civil Action, is about a lawsuit that began with the death of twelve people, and eight of those twelve people were children. This all takes place in the little city of Woburn Wells, Massachusetts. This is a small city that has two companies that are located really close to the cities river.
One company is called W.R. Grace Company and the other is Beatrice Foods. Jan Schlitnmann is the main attorney for the plaintiff’s side along with his partners; Conway, Gordon, and Crowley. The attorney for W.R. Grace was William Cheeseman, and the attorney for Beatrice foods was Jerome Fatcher.
Anne Anderson initially told one of Jan’s partners her story and put many calls into their office. However, she never a response from them! So Anne put a call into Jan Schlitchmann while he was on a radio show. Jan and his partners discussed the case and Jan agreed to go and meet with Anne and the family member’s of the children who died from Leukemia. So he went to the city of Woburn Wells. Jan saw the companies W.R. Grace and Beatrice Foods and thought it would be a goldmine for the law office to take on the case. Anderson told Jan that she and the other families were not looking for money in this lawsuit. The families only wanted an apology from the companies and for someone to clean up the area and make sure it would not ever happen again.

The drinking water that the town had been drinking was the problem. The water had somehow been contaminated with trichloroethylene and silicon (used to water proof leather).

Jan was going to prove in court that W.R. Grace and Beatrice Foods knowingly contaminated the river that was located in Woburn Wells and by contaminating the river it caused twelve people to die from leukemia.

ISSUES:
Did the drinking water that was contaminated with Trichloroethylene and silicon, by W.R. Grace Company and Beatrice Foods, cause the leukemia deaths and other health problems in Woburn, Massachusetts?

Consequently, this means that the plaintiffs lost a 20 million dollar settlement deal for nothing. Ultimately, the plaintiff’s become desperate, they have no money and no way to pay of all of their debts. They end up settling on an 8 million dollar deal with Grace. “A settlement agreement has been reached between both parties. The exact conditions shall remain private between the parties involved” [1]. Accordingly, the plaintiff’s family would get 375 thousand each but with no apology and additionally, no clean up. Schlichtmann and his firm falls apart as they are all left with nothing but bankruptcy. Because of the plaintiff’s excessive settlement demands and gambling, they lose everything thanks to this case. Furthermore, Schlichtmann gives his files to the EPA, who end up ordering a 69.4 million dollar cleanup of the contaminated area. In which, Beatrice and Grace had to pay for. Ultimately, both the plaintiffs and defendants ended up paying more in the long run. In the 1993 Missouri court case Ropers v. Simmons, Christopher Simmons (17 y/o), accompanied by his two friends Charles Benjamin and John Tessmer, devised a plan to kill Shirley Cook. The full plan was to commit burglary and homicide by breaking and entering the residence, tying up the woman, and tossing the victim off a bridge (We the People). The night of the murder the three met at midnight, Tessmer later decided to drop out of the plan. Without Tessmer, Simmons and Benjamin broke into Mrs. Crook's home, bound her hands, covered her eyes, and then drove her to a state park and threw her off a bridge. Although Simmons later pleaded innocence because of the evidence, leading up to the crime, Simmons had expressed to his two friends that he wanted to murder someone (Roper v. Simmons). He deliberately planned this murder for months and presented his plan to his two friends who later played a significant role in the ruling.…

The beginning case that is first brought up by the parents of the deceased children who passed away to leukemia was blown off by Jan, “ I really wish I could help you but I can’t I’m sorry.” Jan is the man in charge of the small firm that later submitted a complaint against Beatrice Foods and W.R. Grace and Company. Shortly after returning back to the office Jan was given some information about what companies had factories out there, once he found out about how large the companies were he quickly returned to the parents and took the case. The whole reason backing the case was the fact that the rate of children getting leukemia was increasing dramatically, as well as everyone in town knowing about the water supply smelling disgusting and that factories there were a probably cause.…

In this case, the residents of Hinkley, CA alleged contamination of their drinking water with hexavalent chromium, also known as chromium 6. The center of the case was a facility called the Hinkley Compressor Station, part of a natural gas pipeline that was constructed in 1952. Between 1952 and 1966, PG&E used hexavalent chromium to fight corrosion within the cooling tower at the Hinkley Compressor Station. The wastewater dissolved the hexavalent chromium from the cooling towers and was released into unlined ponds at the plant site. This wastewater permeated into the groundwater, affecting an area near the plant “approximately two miles long and nearly a mile wide” (PG&E Hinkley Chromium Cleanup). I will further discuss some of the ethical issues involved in this case.…

In this instance, Ms. Barnes forgot the notion, “it's not what you think you know, but what you can prove”. She failed to present any hard facts or evidence in her accusations. In a similar case, Ronald Durando and Gustave Dotoli v. Nutley Sun and North Jersey Media Group, Inc., the Plaintiffs failed to prove the Nutley Sun meant to cast a false light on their charges filed by the SEC. 209 N.J. 235 (2011). Citing the two Plaintiffs were being charged with criminal activity and not arrested, Nutley Sun accidently misreported the facts as the opposite. The courts did find for the defendants; as the headline claiming the Plaintiffs were arrested was not done with malice intent nor, what the newspaper truly meant to report. This is not the case with the blog article posted in relation to Shea Simmons. Blantly, she was blamed for the lost Greenward Academy suffered. While, Mr. Winchell is just as guilty for his role in the blog posting. He cited that he “encouraged her to follow through on this idea” (Cameron Winchell, line 46). His approval on the blog posting could have easily prevented this matter had he acted on his hindsight, and not his emotion of bitterness due to…
