A Case of Mistaken Identity

The quiet drive suddenly turned into a nightmare when a car with three men in it overtook them. The man at the back seat appared to have a gun and pointed it Thomas and motioned him to stop. Horrified, Thomas had no choice but to accept the gunmans orders. He stopped at the side of the road. The four friends sat quietly and petrified, wondering what this was all about.

One of the men yelled out in a loud voice for Thomas and Paul to get out of the car with their hands up while John and Stewart stayed in the car guarded by one of the men. While everyone one was frightend and a bit stressed out small chatter was being talked by the three men. Paul could not hear all of the conversation however he heard a few words which were, “ Broken arm ... Skinny ... Fiat .... Four people “ and asked Thomas what could this mean.
Finally one of the men started speaking and took out a badge and identified himself as a police officer for the Miami police department. While his men frisked Paul, John, Stewart and Thomas, John noticed a slight change in the officers expression from ecstatic to a slight dissapoitment. Satisfied and unsatisfied at the same time that they were unarmed, he demanded to see all of their identity cards. Paul and Thomas handed their ID’s over while John and Thomas were not required to produce an identity card to the police officer. The officer scrutinized the cards.

This ensures searches and seizures by police officials are reasonable. Although there is Supreme Court precedent in the Illinois v Rodriguez case to oppose increased protections of people’s rights under the Fourth Amendment, the Right to Know Act should be passed into law because it would make the community safer for LGBT groups and people of color and the amount of unlawful searches that occur will decrease. The passing of the Right to Know Act will allow for Lesbian, Gay, Bisexual, and Transgender groups and people of color to possess feel less threatened by the…
