Why Do We Need A Bounty Hunter?
Bounty hunting is legal in many of the states across the United States. Bounty hunters do not have any official capacity, but the law provides significant leeway for bail bondsmen to recover fugitives who attempt to skip out on court. Before a bounty hunter can act, a judge must usually issue a bench warrant, which authorizes the immediate arrest of a suspect for failing to appear in court. Bounty hunters have significant different rights than a police officer. When a person agrees to a bail bond contract, they agree to allow a bounty hunter to come after them if the suspect fails to appear in court. Eddie offered Jack 50 thousand dollars in exchange for the return of Johnathon Mardukis, a fugitive on bail for 450 thousand dollars and is on the run from the Federal Bureau of Investigation and the mafia. Jack counteroffered by raising the amount to 100 thousand dollars for the return of Johnathon. Eddie accepted the counteroffer for the return of the fugitive by Friday or he will have to close the bail bond business. The amount in consideration for Jack is 100 thousand dollars, even though the mafia eventually offers Jack one million dollars for Johnathon. Jack had the intent to bring Johnathon Mardukis to Los Angeles for Eddie in exchange for 100 thousand dollars. Both parties in the agreement had the legal contractual capacity to create a contract. Neither person was considered a minor, an intoxicated person, or an insane person. The legality of bounty hunting subject matter is lawful. Jack’s ways of conducting business in today’s time could be consider illegal in some states. If Jack fulfilled his parties side of the contract with Eddie to have the fugitive, Johnathon Mardukis, in Los Angeles by Friday, Jack would have a legal enforceable contract for the 100 thousand dollars in consideration. Jack stated the terms of the contract when he said “That’s right. I want it in writing, 100 thousand dollars and I’ll have the Duke here for you by Friday night. A contract does not have to be in writing to be enforceable, however, some contracts require a writing agreement, for example: sale of land or interests, contracts that cannot be performed within a year, promise to pay the debt of another, promise made in consideration of marriage. Jack and Eddie’s agreement for the return of Johnathon Mardukis wouldn’t need a written contract because Jack was fulfilling an order from the person who he coordinates bail bonds business with.
