Walter V. Johnson Lease Case
Mr. Chung estimated that he started his lease at 1361 Newton Street, Los Angeles, CA somewhere in either in 2009 or 2010 from the Smith and Company and dealt specifically with the leases Representative Bill or AKA: William Weiss. He said he rented out a small storage space which was a 12’x12’ storage space where he stored props and extra vases at the extra storage space, which he rented out for space for cash at $50.00 per month and with a check for $25.00 month and would give him $25.00 in cash. He said the place where space he would lease would be at the Mezzanine level of the building.

He said Mr. Weiss would come by his central office at his floral shop at 10653 W. Pico Boulevard, Los Angeles, CA 90064 to drop off the monthly bill, which he would pay Mr. Weiss in the form of payment with a check and cash. He stated the checks were based upon a lease agreement at $25.00 per month with cash and the rest of the rent would be paid with a check at $25.00. He said money was based on a verbal basis and the check was in the lease agreement, of the same amount of $25.00.

Weiss would sometimes present him with four consecutive bills for four months where he would then write him a check for four months at the cost of $ 100.00. He said Mr. Weiss would allow for him to go without paying the monthly lease for a few months but nothing more than four months, since the monthly rent was so cheap.

He sometimes said there might be a trade-off where he would give Mr. Weiss business in having him make various steel props such as steel vase holders, where he would pay Mr. Weiss for his work including rent. He said the trade-off would be where he would not have to pay rent each month and hold the rent over for a few months before he paid it.

He said when he wrote out the checks; Mr. Weiss would either have him write out the checks in his name under Bill Weiss or Smith and Company; depending what Mr. Weiss wanted him to do in paying

    On October 3, 1974, Memphis Police Officers Hymon and Wright were dispatched to answer a "prowler inside call." When the police arrived at the scene, a neighbor gestured to the house where she had heard glass breaking and that someone was breaking into the house. While one of the officer radioed that they were on the scene, the other officer went to the rear of the house hearing a door slam and saw someone run across the backyard. The suspect, Edward Garner stopped at a 6-feet-high fence at the edge of the yard and proceeded to climb the fence as the police officer called out "police, halt." The police officer figured that if Garner made it over the fence he would get away and also "figured" that Garner was unarmed. Officer Hymon then shot him, hitting him in the back of the head. In using deadly force to prevent the escape of Garner, Hymon used the argument that actions were made under the authority of the Tennessee statute and pursuant to Police Department policy. Although the department's policy was slightly more restrictive than the statute it still allowed the use of deadly force in cases of burglary. Garner's fathers' argument was made that his son was shot unconstitutionally because he was captured and shot possessing ten dollars that he had stolen and being unarmed showing no threat of danger to the officer. The incident was then reviewed by the Memphis Police Firearm's Review Board and presented to a grand jury of the Federal District Court and the Court of Appeals.
