VEHICLE 1:

Vehicle 1 was a white 1994 Honda Civic DX, two door hatchback vehicle, bearing Florida tag, 562 0QM and VIN#: 2HGEH2461RH507024. The vehicle was registered to Shawn Anthony Barker of 11605 North Street, Gibsonton, Florida 33534. Vehicle 1 had a registered curb weight of 2201 pounds.

A post collision examination of Vehicle 1 revealed it was powered by an electronic sequential port fuel injected, 102-hp 1.5 Litre, in-line 4, SOHC, 8 valve engine, with no apparent modifications. The drive train consisted of a front wheel drive, 5 speed manual transmission with overdrive, with no apparent modifications and both components appeared to be in good condition with no notable deficiencies.

The vehicle was registered to Okhiaofe Mary Awobusuyi, of 10435 Flagstaff Falls Avenue Riverview, Florida 33578. Vehicle 2 had a registered curb weight of 3072 pounds.

A post collision examination of Vehicle 2 revealed it was powered by a multi-point fuel injected, 175 hp, 2.5L in-line 4, DOHC, VVT,( variable valve timing), 16 valve engine, with no apparent modifications. The drive train consisted of a front wheel drive, 2 speed continuously variable speed automatic transmission, with no apparent modifications and both components appeared to be in good condition with no notable deficiencies.

Vehicle 2 was equipped with a four wheel independent suspension with front strut suspension and front stabilizer bar, with front coil springs and gas pressurized shocks. Vehicle 2 was also equipped with a rear multi-link rear suspension with a rear stabilizer bar, rear coil springs and gas pressurized shocks. Vehicle 2 had rack & pinion, hydraulic power assisted

An examination of the tires on Vehicle 1 revealed all four tires to be Continental brand radial tires, 215/60R16 in size. From the right rear tire, clockwise around the vehicle, the tires were inflated to 36 psi, 35 psi, 39 psi. The right front tire was flat due to the crash. All the tires were in good condition with an average tread depth of 8/32's.

Vehicle 2 appeared to be in good working order. A search of the National Highway Traffic Safety Administration Recall database produced four recalls for Vehicle 2, campaign #’s: 10V401000, 08V521000, 08V363000 and 07V599000. Based on a review of the recalls, it does not appear that a mechanical failure or defect was a contributing factor in this crash.

Vehicle 2 sustained damage to the right front quarter panel, front passenger door and the hood and right front bumper.

Driver 2:

Okhiaofe Mary Awobusuyi, had a valid Florida 'class “E”' Driver’s License, A120-653-85-866-0, which was issued on 05-02-2009 and included no endorsements or restrictions. Okhiaofe Mary Awobusuyi's current address is 10435 Flagstaff Falls Avenue Riverview, Florida 33578. A search of Okhiaofe Mary Awobusuyi's Florida driving history revealed no entries. Okhiaofe Mary Awobusuyi was wearing her seatbelt at the time of the crash and received non-life threatening

    In July 1998, Sam Boyden from State Farm Insurance received a call from a claims adjuster inquiring about Firestone tread separation. Sam began to research this issue and he found that there were 20 more such cases going back to 1992. All 21 cases involved Firestone ATX tires and 14 of them involved the Ford Explorer. He then sent an unsolicited e-mail to the National Highway Traffic Safety Administration (NHTSA) describing the 21 Firestone cases. In return, The NHTSA thanked him but did not follow up on the complaint. Sam Boyden proceeded to track the problem and during 1999 noticed another 30 such cases. He continued passing on the information to the NHTSA. In February 2000, Houston’s KHOU TV station aired a segment on tread separation. The station's report on tire problems prompted several dozen people in Texas to report similar trouble to regulators. Immediately thereafter, the NHTSA began studying the problem of Firestone tires. In May 2000, after accumulating 90 complaints involving four deaths, the agency opened a formal investigation. The investigation encompassed all 47 million AT, ATX and Wilderness tires made by Firestone over the last decade (1990-2000). By the beginning of August 2000, the NHTSA had recorded 68 fatalities in rollovers of Ford Explorer SUVs caused by sudden tread separation of Firestone tires. All except two dozen of the complaints came in year 2000, even though the Explorer had been on sale since 1990 and a handful of lawsuits citing tire failures were filed as early as 1993. By August 16, 2000, the government data included public complaints of 52 deaths in Explorers that rolled over after Firestone tires failed, and five more deaths in Explorers for which the complaints did not mention whether rollovers occurred.
