    Managing Laws and Ethics

    • 1004 Words

Laws and ethics are a touchy subject, even the brightest minds in the world have a tough time coming up with the “right” answer. When applying social responsibility with ethics, we must look at it from multiple sides; let’s use an example, Robert was interested in learning about the workings of professional burglars. Several years ago, he made contact with someone who could put him in touch with a professional burglar, although the burglar had retired several years ago. He contacted this person, who forwarded his interest on to the "retired" professional burglar. The burglar agreed to participate in a series of interviews. The first two interviews went fine, but on the third occasion, his subject indicated that he was planning a burglary in a new development. This was to be a one-time event (rather than a return from retirement) involving burglarizing the home of a wealthy resident in this development. Robert promised his subject anonymity and confidentiality at the outset of his research, but he now had information indicating that a crime was about to be committed. In analyzing laws and ethics in this case, if Robert was being ethical for the integrity of the burglar and did not inform the police of his deeds, he was being unethical in the social responsibility aspect of ethics! When respecting people’s rights, dignity, and diversity, people are going to be affected negatively either way in certain situations. What we need to ask ourselves is, do we act unethically to the side that is committing a crime, or unethically to those who are not?…

The Constitution of the United States, in Article I, prohibits Congress, and the states from enacting ex post facto laws (Brody & Acker, 2010). That is, laws cannot be passed, making an action illegal, and then be used to prosecute a person who had committed that act prior to the passage of the law. At the same time, laws that are changed, in such a manner as to increase the punishment for violations, cannot be applied to persons who have been previously convicted for violating that law. It is this meaning of ex post facto laws, which directly affects the criminal justice system.…

Number four is don’t tube with other people. Tubing is a great time for everyone to show their introvert and loner side. So do that and stay away from people on that tube because all they do is mess up or wipe someone out because they are inexperienced. Nine times out of ten I do not tube with other people. I do this because I am better on my own and if I do tube with people I end up just pushing them off the tube.…

Laws are a familiar concept, and provide a basic social framework of right and wrong to which the majority adhere. Ethical theories may also be applied to all issues of uncertainty, including those not covered by laws or professional guidelines. They create a mechanism within which issues of moral uncertainty may be questioned and resolved (Jones 1994). One such area of moral dilemma is that of informed consent.…
