The Role Of Defamation In The Grocery Store
Yes the grocery store many have violated the law of defamation if they do not have proof that the man was actually trying to steal. Until they have actual proof they cannot say that a person was stealing just because a person thought they saw him take something. Defamation is a statement that is not true that was made against another person to a third person that could tarnish a persons’ reputation. Defamation could be slander in oral or spoken form, and can also be libel which is written or broadcasted. Just because the employee saw Mr. Man pick up a few steaks, does not mean that he was going to try and steal them.

    On Tuesday evening around 8:15 pm, Mr. Martin A. Wallace accompanied by his father and two daughters, entered an Olive Garden Restaurant expecting to be greeted with a friendly smile and great customer service. This was not the case. Instead, Mr. Wallace was not greeted by any host/hostess, but instead an empty station. After waiting about ten minutes, he went to the bar to find someone to seat him and his family. Only then did a hostess take them to their table and appeared to be annoyed. The hostess tried to seat them in a section that was not possible for Mr. Wallace’s father to get to easily since he is handicapped. After a short conversation, she then took them to a dirty table and just tossed the menus on the table without waiting for them to be seated. When his family picked up the menus, they noticed one was a lunch menu and the other girls did not receive a children’s menu. It took Mr. Wallace another 15 minutes to have a waiter take their drink and meal order. Once the food arrived 20 minutes later, the meals were cold and Mr. Wallace was informed he could not have the wine he ordered as the Olive Garden was all out of wine. He also had to request for silverware and napkins. Mr. Wallace then requested to speak to the manager regarding the ordeal. The manager also appeared annoyed that they were in the dining room so late in the evening, but did have the kitchen replace only his meal and the rest of the family ate theirs cold. The family then waited another 15 minutes for the check, but it never came. Mr. Wallace had to go back to the bar to request the manager and the check and was rudely confronted by the manager for doing so. The family left well after 10 o’clock on a Tuesday night not happy with their service and not given even a free drink for the huge inconvenience that it caused.…

    Given that our society has such a dense population of different races, ethnicities, religions and sexual orientations, it is important to understand both the goals and challenges of policing and dealing with hate and bias crimes. Considering that since the beginning stages of immigration we have tried to support successful assimilation, hate and bias crimes create a huge barrier. Hate and bias crimes “occur when a perpetrator targets a victim because of his or her membership in a certain social group, usually defined by race, religion, sexual orientation, disability, ethnicity, nationality, age, gender, gender identity, or political affiliation” (en.wikipedia.org). Not only is it difficult for our society to identify this sort of crime, but it is also extremely hard to enact comprehensive laws governing the way police and society as a whole should handle these crimes. An important problem associated with bias and hate crimes is distinguishing them from other “everyday” crimes; often, the terms are used interchangeably. Law enforcement as well as the general public should understand that bias and hate crimes are in many ways the same crimes that are committed everyday, but that hate and bias crimes are committed intentionally against a person because of a certain bias and are usually much more violent. Furthermore, deciding how offenders should be identified and punished is sometimes problematic “because motivation is subjective, [and] it is often difficult for police officers to determine whether an offense was motivated by bias” (Katz, pg 301)…
