On July 29th, 1984, Jennifer Thompson woke to a stranger in her room, who proceeded to brutally rape her, with a knife close to her throat. Jennifer stayed as calm as possible, trying to identify her attacker to ID him to the police once she escaped. Eventually Jennifer managed to escape and informed the police department. When presented with a small number of suspects that the police department had identified, Jennifer picked Ronald Cotton. Ronald Cotton was informed of the charges and actually went to the police station to clear his name. Ronald already had a less-than-desirable record with the police which could have played a role in his conviction. Not only was Ronald Cotton a young black male but already had a criminal record for a mistake he did when he was only a kid. Nonetheless, based on that fact alone the jury will see Ronald in a different light and will have an impact on the verdict. The same could also be said for all five individuals of the central park five. Prior to the conviction of all five, Kevin Richardson, 14, Raymond Santana, 14, Yusef Salaam, 15, Antron McCray, 15, and Kharey Wise, 16, also confessed to —“chasing after bicyclists, assaulting pedestrians, and (in two separate incidents) pummeling two men into unconsciousness with a metal pipe, stones, punches, and kicks to the head.” these confessions were caught on tape. The press coverage surrounding the case made…

Anthony Sowell moved in with family directly following his release. He moved into a Cleveland home on Imperial Avenue. To say that Ronald Cotton’s experience represents the worst of the American Criminal Justice system is an understatement, he is proof of the countless bumps and flaws it endures. So while being raped she decided to take mental notes on her attacker that would later help her identify him to the police. After helping put together a sketch of her rapist with the police she was asked to come in for a photo lineup and a physical lineup. That is when she identified Ronald Cotton, an innocent man, as her rapist, saying she was “absolutely certain” it was him. Thompson was then…

In May of 1987, a young woman was raped in Scarborough, Ontario. This was the first in a series of rapes which the media would begin referring to as “The Scarborough Rapist” (Sellers). The rapist was, in fact, Paul Bernardo, then 23 years old. He would eventually admit to fourteen rapes; he was associated in as many as 50 (Sellers). Five months later Bernardo met Karla Homolka, then 17, in a hotel restaurant in Scarborough. Prior to meeting Bernardo, Homolka had shown no signs of criminal or irregular behavior (Sellers). She quickly fell in love with Bernardo and the two became a couple. There is no suggestion that Homolka was aware of Bernardo’s was the Scarborough Rapist. The two did, however, participated in aggressive sexual play, with Bernardo showing great interest in having sex with a virgin something Karla Homolka could not provide. Karla’s younger sister Tammy, then 15, became a target of Paul’s attentions and Karla, demonstrating her willingness to “do anything” for Paul, participated in planning a strategy in which the two would drug Tammy and, while she was asleep, rape her (Sellers). The couple first tried to implement the plan in July 1990, giving Tammy a spaghetti dinner laced with Valium but Tammy woke up shortly after the rape began and the couple had to abandon their plan (Sellers). On December 23 of that same year, Bernardo and Homolka drugged Tammy Homolka using the animal tranquilizer halothane which Karla had stolen from her job (Sellers). With Karla videotaping, Paul raped Tammy in the family room of the Homolka house; however during the rape Tammy choked on her own vomit and died. Karla and Paul successfully covered up the evidence and Tammy’s death was ruled accidental (Sellers). Homolka and Bernardo would then go on to trick rape and release a young fifteen year old girl, in June of 1991 Bernardo kidnapped 14 year old Leslie Mahaffey (Sellers). With Homolka, he raped and murdered her, disposing of the body in concrete. Next in…

Facts: Kyle John Kelbel was convicted of first-degree murder, past pattern of child abuse, in violation of Minnesota state statute section 609.185(5) and second-degree murder, in violation of Minnesota statute 609.19, subdivision 2(1). He was sentenced to life in prison for the death of Kailyn Marie Montgomery. Kelbel appealed, and argued that the district court failed to instruct the jury that it must find that the state proved beyond a reasonable doubt each of the acts that constituted the past pattern of child abuse and he also argued that the evidence against him was insufficient to prove past pattern of child abuse against Kailyn. Kelbel testified that the head injury of Kailyn was inflicted by a cup thrown at her head by step brother Evan. Kelbel also testified that other injuries found on Kailyn were caused by Evan and that he is "rough" with her. Medical examiners ran an autopsy on Kailyn's body and determined that the injuries had been caused by blunt trauma and force caused by a knee or fist. Medical examiners testified that the injuries caused could not have been caused by a cup thrown at her head or by an accidental fall down the stairs. Kailyn's mother, Lindsey, also testified that Kailyn had previous injuries that she became concerned with. Upon retrieving a search warrant, police entered Lindsey's home to find further evidence. Police found a dent in the wall near Kailyn's bed. After Kelbel was eventually found guilty of the charges brought, Kelbel filed a motion for a judgement of aquittal and for a new trial on the grounds that the evidence was insufficient to support his conviction. The district court denied the motion.…
