TASK 1.1
The relevant codes of practice are:
• Every Learner Matters 2004 – Its main aims are for every child, whatever their background or circumstances, to have the support they need to:
• Be healthy
• Stay safe
• Enjoy and achieve
• Make a positive contribution
• Achieve economic well-being

• Race Relations Act 1976 & 2000 – Places a statutory duty on schools/colleges to promote race equality.

• Disability Discrimination Act 1995 & 2005 – Protects the rights of all those with disabilities. Eliminate barriers to ensure that individuals can gain access to equal services.

• Children’s Act 1989 & 2004 – The Children Act 1989 aimed to ensure that the welfare of the child was paramount, working in partnership with parents to protect the child from harm.

• Child care Act 2006 – The Act improving the Every Child Matters outcomes for pre-school children, childcare for working parents & parental information services

• SEN Code of Practice 2001- The code is designed to help these bodies to make effective decisions regarding children with SEN. It does not (and could not) tell them what to do in each individual case.

• Human Rights Act 1998 – Sets out the rights of all individuals and allows them to take action against authorities when their rights have been affected.

UNCRC 1989 - The Convention says that every child has:
• The right to a childhood (including protection from harm)
• The right to be educated (including all girls and boys completing primary school)
• The right to be healthy (including having clean water, nutritious food and medical care)
• The right to be treated fairly (including changing laws and practices that are unfair on children)
• The right to be heard (including considering children's views)

• Equality Act 2006/10– To protect the rights of individuals and advance equality of opportunity for all.

• Gender Recognition Act 2004 – This allows transsexual people to change their legal gender.

    Education has also seen notable improvements when the act came into fruition as the percentage of those with special educational needs achieving 5 or more A*-C grades rose by a total of 56% between 2005 and 2011(2). Whilst the grades of those with disabilities have improved, it appears that the experience in education hasn’t had a great effect due to the act as 26% of disabled people in education reported having a negative experience largely due to the attitudes of others and lack of correct facilities(3). The poor attitudes and lack of facilities may come from the fact that 83% of disabled students are in mainstream education (4) which cannot necessarily cater for their needs to the same standard of a special needs school.…

    If these code’s of practice and legislations where not to be followed the consequences can be diverse. They can effect just one individual or can effect an entire team of social care workers. By not following the codes of practice and the legislation you could cause a s.u to feel discriminated against which would have negative effects such as making them feel isolated or un-heard and could lead to more problems that would effect the people around them as well as the individual . By not using inclusive practice you may find that the S.U might be put in a situation in which they are not happy which could make them act out in a way that could effect their future and how other team members interact with them. For example by failing to us an inclusive practice with an s.u by taking them to a public park, without first consulting or discussing this with the s.u they could miss out on important information such as the s.u being afraid of dogs, this could then lead to an incident due to there being dogs at the park.
