Assessment task – TDA 2.8 Support children and young peoples Health and Safety Task links to learning outcome 1, assessment criteria 1.1, 1.2, 1.3 and 1.4 Describe how current health and safety legislation, policies and procedures are implemented in the setting Health and Safety Legislation is there to protect everyone within a setting, (everyone being pupils, staff and visitors) through policies and procedures for preventing and controlling risk of accidents. All those working in school have a duty to ensure the Health and Safety of children in their care along with their own health and safety and that of colleagues and visitors. Children and Young people need to be allowed to explore their environment and learn for themselves, but that environment must be safe and as healthy as possible for them to be able to play and learn. The Health and Safety regulations relevant to schools are as follows:- Health and Safety at Work Act 1974

Ensures the health and safety of you, your colleagues and children in your care. This Act has meant that settings have policies and procedures that ensure the relevant checks are made to prevent accidents and remain vigilant with regards to hazards. The setting must have a Health and Safety officer to whom any significant incidents and hazards are reported. The setting must have protective clothing available and any tools and equipment are kept in good working order. The setting must ensure they cooperate with relevant authorities and their requirements. The practitioner will always be looking for potential hazards and ways to prevent accidents – risk assessment. Practitioners will assess their own behaviour and that of others to ensure it is safe. As long as there is adequate signage and information anyone within the setting will benefit from this legislation. Workplace (Health, Safety and Welfare) Regulations 1992

This regulation covers a wide range of basic health, safety and welfare issues to include the following: Health
Temperature in indoor workplaces
Cleanliness and waste materials
Room dimensions and space
Work stations and seating
Floors and traffic routes
Falls into dangerous substances
Transparent or translucent doors, gates or walls and windows Windows
Doors and gates
Escalators and moving walkways
Sanitary conveniences and washing facilities
Drinking water
Accommodation for clothing and facilities for changing
Facilites for rest and to eat meals
The Workplace (Health, Safety and Welfare) Regulations 1992 are intended to protect the health and safety of everyone in the workplace ( including the disabled) and ensure adequate welfare facilities are provided for people at work. Health and Safety (Young Persons) Regulations 1997

These regulations apply to situations where young people (defined as those under 18) are at work, and covers children at work. This legislation applies to young people and children on training schemes, work experience etc, and places the onus for compliance on the employer. In summary, young persons should not be expected to do:

* work beyond their physical (manual handling) or psychological capabilities (decision making) * work involving harmful exposure to radiation
* work involving risks to health from noise, vibration or extreme heat/cold * work involving harmful exposure to any agents that can chronically affect them. It is also good practice to include a review of the young person's current state of health and look at other personal factors, which may influence the risk assessment process. Care Standards Act 2000

This act establishes a National Care Standards Commission, to make provision for and include and amend the law about children looked after in schools and colleges. By setting ional Minimum Standards the act safeguards and promotes the welfare of children for whom accommodation is provided. (Specifically boarding schools).
