The Integration of Legislation into EMS Policy and Procedure
The technique to emergency medical services (EMS) is to encourage an integrated and robust legislation process with government officials. The assertiveness to emergency medical services, which includes enhanced prevention and mitigation for emergency responses in the community come from a number of policies and laws. One such law is the, “Good Samaritan laws” these laws have different purposes and function. In January 2012, Governor Christie passed the, “Good Samaritan Emergency Response
Act; eliminates criminal liability for persons who seek medical assistance in response to drug
Overdose” (Govtrack.us/states, 2012, p. 1). Good Samaritans can now feel welcome to dial 911 when reporting a drug overdoses without dread of legal concerns for the victim of the overdose or the person making the call. The law also protects the person (Good Samaritan) if the use of opioid antidote is used on the overdosed individual. (Govtrack.us/states, (2012).
Emergency medical personnel and ordinary residents in New Jersey can administer opioid antidotes to overdosed casualties without the dread of someone taking legal action. The law does not preclude law enforcement from indicting a person with a crime by means of evidence recovered from scene that is independent of the person making the call for medical assistants (Govtrack.us/states, (2012). …show more content…
Laws for the Good Samaritan inspire onlookers to provide assistance to others that are in apparent hazard and he or she can be reasonable safe when doing so. The Good Samaritan believes he or she is protected from any legal responsibilities when practical actions are taken to assist individuals in apparent danger. The Good Samaritan must remember that every state has a Good Samaritan statute, but the performer’s eligibility for coverage and qualifying circumstances under which care is delivered varies.
