OSHA Lawsuit The U.S. Department of Labor filed a lawsuit in the U.S. District Court for the District of Montana against a Helena-based company named Kbec Inc. in January 2013. Kbec Inc. is a Dairy Queen franchisee that, “illegally terminated an employee for making complaints regarding workplace violence at the company 's facility.” (Todd & Rodriguez, 2013). In this article, there are no details given on what was the nature of the complaints filed by the employee originally, however, searching the internet for other related articles, I found one of a reason for which the employee may had been terminated, “OSHA says the employee was fired after complaining about a potentially unsafe situation of finding the building unsecured when she arrived, alone, to open the store. The worker also filed a safety and health complaint with OSHA, which triggered an OSHA inspection that identified two unrelated violations.” (Two Whistleblower…, n.d., p. xx-xx). …show more content…
could have done a lot to address the situation as soon as it learned of the complaint. First of all, securing the doors of the business should have been of outmost priority, not only to insure the safety of the employees, but to safeguard the equipment, inventory and other items that may been left in the store overnight. Launching an investigation to find out why the door was not secured, should not have been a major issue as it was. Making sure the employee’s was heard and safety precautions put in place should be a first priority to every employer, these safeguards could not have been costly at all either, there should not have been any

    1. What were the legal issues in this case? This case is based around the laws and regulations of OSHA. OSHA is an Occupational Safety and Health Act that has been put into place to ensure the safety of employees while on the job. These regulations are put into place to help reduce the number of on the job injuries and death. In this case, Williams Construction was put under investigation after a trench collapse, which resulted in the death of one employee and a serious injury in another. After the investigation Williams was charged with four OSHA violations that all resulted in expensive fines. The issues that arose from the investigation included; the failure to instruct employees and managers on how to recognize and avoid hazardous work conditions, the failure to ensure that employees did not have to travel more than twenty five feet to a safe zone, the failure to have a “competent person” that was specifically trained in trench safety and the final violation was the failure to make sure that the walls of the evocation were either sloped or supported. It is the belief of OSHA that if these regulations were followed that this tragic accident could have been avoided.
