State and Federal Court Systems

There are three prominent differences between the State and Federal Court Systems and they are the structure, the cases heard, and the sources of laws. In the following information there will be a brief explanation of the key difference between the Federal Court System and the New York State Court System.

The main purpose of the Federal Court System is to hear that cases that usually have a direct conflict with the United States as a whole and not necessarily cases that affect a citizen unless that case were to involve certain aspects such as violation of Constitutional Laws or when the United States is considered a party within the case itself. The basic structure of the Federal Court System is dictated within the United States Constitution and is completely regulated by the Government.

The New York State Court System is one of the most confusing yet successful Court Systems as compared to the other 49. Arguably the most confusing part about the Court System is the names of the Courts themselves. In most other states the highest Court is usually the State Supreme Court however New York’s highest Court is the Court of Appeals. Unlike the Federal Court, New York State Courts deals with cases that include some of the following…criminal cases, property cases, violation of various State laws, and various traffic violations. Unlike the Federal Court Judges, the Judges in New York State are elected; however they are not necessarily elected by the citizens but rather the political parties themselves, so in essence the New York State Court has similar yet different methods for appointing their Judges.
