Lesson Outline

Objective: The objective of this lesson is for each student to be able to define sexual harassment, give examples, state ways to stop the harassment, and state options for reporting.

1. Definition of sexual harassment – Paraphrased from The Citadel’s policy
a. Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature.
b. It is usually repeated behavior, but could be one serious incident.
c. It is frequently a display of formal or informal power intended to demean, embarrass, intimidate, or coerce a person.
d. Sexual harassment can occur between members of the same sex.
e. There are two types of sexual harassment:
i. Quid pro quo sexual harassment:
1. Submission is a condition of advancement or opportunity
2. Submission to or rejection of such conduct is used to make decisions affecting an individual’s advancement, academic standing, or opportunities ii Hostile environment sexual harassment:
1. Such conduct has the purpose or effect of unreasonably interfering with a person’s work, academic performance, or creates an intimidating, hostile, or offensive work, learning, or social environment.

2. How do people sexually harass?
a. Verbal:
1. Unwanted requests or demands for sexual favors
2. Propositions
3. Questions about a person’s sexual practices
4. Lewd Comments
5. Sexual insults or innuendoes
6. Sexually explicit jokes
7. Demeaning toward gender
b. Visual:
1. Leering
2. Sexual graffiti
3. Sexually explicit pictures, cartoons, or objects
c. Physical:
1. Unwanted touching
2. Fondling
3. Pinching
4. Kissing
5. Blocking a person’s way

3. Reporting
a. Informal
1. Aimed at stopping behavior, not determining culpability or intent
2. Optional and voluntary
3. May handle complaint on own, or have a member of the chain of command talk to and/or provide training to the harasser or unit
4. Does not usually require an investigation
5. How to handle:
a. Tell offender that behavior is unwelcome and to stop
b. Put a copy of the SH policy in the offender’s mailbox
c. Send a letter to the harasser
d. Seek advice or assistance from the Ombudsperson
e. Discuss the matter with an immediate supervisor in the chain of command and come to an agreement

b. Formal
1. Used when—
a. The complainant requests it
b. The Citadel files its own charges
c. A third party requests it (not direct victim of harassment but feels conduct interferes with academic performance or welfare
2. Procedures:
a. Aim is to discover if accused violated SH policy and, if so, to provide sanctions to stop the harassment
b. Always requires an investigation, including a formal written report
c. Complaint must be in writing
d. Harasser can be disciplined if found guilty
e. Due process adhered to and all parties must be respected
f. Confidentiality is maintained to the greatest extent possible
g. All parties should be interviewed, as well as witnesses and third parties
h. Investigations of allegations involving a cadet will be conducted through a Commandant’s board of hearing. Blue Book/White Book procedures are followed. Recommendations of suspension, dismissal, or expulsion will be forwarded to the president for final action.
i. Title IX Coordinator will receive copy for filing
j. BOV is final appeal authority
k. No right to legal representation as boards are administrative in nature
