Sexual Harassment in the Work Place
“Title VII of the Civil Rights act of 1964, employees in the United States of America is protected from workplace discrimination based on race, ethnicity, color, religion, or gender. Additionally, Title VII prohibits employment discrimination based on association with any race, ethnicity, color, religion, or gender.” “In addition to prohibiting workplace discrimination based on the listed attributes, Title VII also contains provisions against sexual harassment in the workplace. Victims of employment discrimination or sexual Harassment in the workplace may seek relief via legal procedure litigation under Title VII of the Civil Rights act of 1964.”
It could be considered Quid pro quo sexual harassment since he threaten to get her fired but since he does not have the ability to fire her I would consider it to be Hostile Environment Sexual Harassment. The female’s job was made uncomfortable and hard to do affectively due to his actions. The company could also face law suits of sexual harassment from the customers due to his actions.
Marwan is an employee of Studio Five Theme Park and must work any assignment handed to him and has to follow strict rules and regulations in order to keep his job. To where if he was a contracted employee he could deny section jobs or assignments he did not wish to do and choose his own hours to work. Contract worker have a little bit more flex ability with the rules they have to follow, but Studio Five Theme Park can still fire them or have them replaced by other workers from that company if their actions are given the park a bad name.
Due to the fact that he had been there so long and it was the first complaint against him I would have suspended him then brought him back on a probation period. I would have also made sure that him and the female employee worked different schedules or different areas of the park to keep her from being uncomfortable.
He had worked for the company for ten years with the disability and never had any complaints or problems, so I do not see how he can say that is the reason he got fired. Marwan would have to prove that Studio Five Theme Park has had issues are made commits about his legs. And Studio Five Theme Park would have to prove that there were no issues with his leg if they even knew about it in the first place. Studio Five Theme Park could pull security footage showing him harassing the female employee as proof of termination.
Due to cases of sexual harassment that I have seen I would say they are responsible for his actions due to the fact they are responsible for any issues that occur on their property. When I worked for Kroger an employee got call out of his name by a customer and sued Kroger they had to pay him a big settlement and in turn he was not allowed back on any of their properties. I am not really sure what happened to the customer or if they even had to take responsibility for their actions. I am sure that Kroger would have proved it in some form to get some compilation from their loss.
I would not think that being part of the union should have an effect on a situation like this but know it does considering the situation I mentioned early was settled by the union and I do not believe that Kroger’s former employee would have got to far in the case without union help.
Company polices to not guarantee protection against harassment due to the fact that the people committing the harassment do not see anything wrong with what they are doing or think that their position in the company will protect them or scare the person being harassed into telling anyone.
It is unethical for Marwan to act that way towards other employees and guest of Studio Five Theme Park. He should have more respect for other people, his employers, and his self than to discredit them that way. Unfortantually it is a major problem in any work place. People tend to think just because they are the boss or in a hire position or standing than someone else they can use it against them. And until more people stand up for their self like the female employee did harassment will continue to be a problem. I have been in her shoes and should have did the same thing she did but due to the position he held with the company I put up with it as long as I could until I end up having to walk away from that job. There are many laws put in place to protect people from harassment and a hostile work environment unfortunately most people fell that they have no choice but to deal with it or loss their job. Or if they do pursue it they think it will just make they work environment more tense and harder to work in due to the fact that most of the time the people committing the offense have made friends with most of the other employees and everyone will be talking about the event even after it is settled.
It is funny how much work is like being in school, it seems like the older we get all the gossip and childishness would stop. However it you think about it all work environments have their own little clicks just like school and all the gossip and backstabbing as school.
