Court Observation Paper
For my court observation, I was able to sit in a Texas State District Court. The judge of the court I observed was Honorable Judge Etta J. Mullin. Everything was pretty much what I expected to see. I wasn’t expecting anything outrageous to happen like on the television. I was expecting everything to be very professional and very boring, like watching the C-SPAN channel.
The walls were a dull brown color and most of the furniture was wooden. The Judge sat on a little stand and next to the stand was a seat where people would go to present evidence or tell stories under oath. On the Judge’s right side, there were two rows of seats that the Jury would sit in. There were police officer standing in the room and people sitting down in the audience like me. I couldn’t tell if they were just spectators in the audience, or family/friends of the people on trial.
When I first entered the courtroom, I walked in the middle of a court case. Most of the court cases were pretty straight forward. People pleaded guilty and the Judge moved on to the next case. The most interesting case was an assault because it was assault. The defendant of this case also pleaded guilty, but afterwards the Judge talked with the lawyer to discuss what sort of punishment or jail time he should receive. Because there were three counts of assault, the defendant was fined $40,000 and 3 years of community service. I thought it seemed fairly reasonable since the one of the victims suffered injuries such as skull fractures. I, however don’t think that I am experienced enough to know what is considered a good punishment for a crime.
Other cases were simple things, like people being caught with possession of marijuana. The penalty for that is a small fine. That reminded me of a time when a guy I knew was caught in possession of marijuana on his was to Waco. He was kept in a holding cell and I had to drive to

    Before going into further discussion I would like to briefly explain the basic conception. Judicial system is designed to punish those people that committed crimes through the system of jury trials where criminal defendant is considered as guilty or not guilty. So, at first glance it looks unavoidable that all criminals are punished according and in proportion to their crimes.     On September 27th I went to Branch 6 to watch the criminal trial of the defendant Lord Wilson. It was making out to be a weeklong trial and I made it on the second to last day. All I knew was that it was a case involving drugs and had been in the making for a while. When I arrived at the public safety building to listen to the criminal trial taking place I learned firsthand that things never seem to stay on schedule. A recess was taking place when I walked in. While I was sitting there I overheard another person in the courthouse talking about how they heard testimonies from witnesses the day before. That’s what I was looking forward to and now I was worried that I wouldn’t get to observe anything too interesting. During the recess I had some time to take in what was going on around me. The judge was not in the court room. I assumed he was probably in his chambers going over information from the trial that called for the recess to begin with. The prosecutor and the defense attorney were both present in the courtroom, occasionally talking to one another while they waited for the judge to return. The defendant was in the room as well, sitting next to his lawyer waiting for things to resume. There were also a few police officers sitting behind me and from what I could tell at least one was involved in the case against the defendant. While I was sitting there Thomas Gerleman, the defense attorney came over and told me who the people involved in trying the case were. The judge who presided over this court room was Daniel Bissett and the District attorney was Christian Gosset. The A.D.A was Eric Sparr, which another student informed me he was a “drug expert” and had a lot of experience dealing with cases involving the delivering and manufacturing of drugs. Knowing who everyone was made it a little easier to follow what was going on.…

    The courts have the function of giving the public a chance to present themselves whether to prosecute or defend themselves if any dispute against them rises. It is known to everyone that a court is a place where disputes can be settled while using the right and proper procedures. The court is also the place where a just, fair and unbiased trial can be heard so that it would not cause any disadvantage to either of the party involved in the dispute. The parties are given a chance to represent themselves or to choose to have a legal representative, which is mostly preferred by many. In the Session Court that I attended, the appearance of the court was similar to other courts that I have seen. The judge sat in the center and in the presence of everyone at the front. The interpreter sat in front of the judge and on the right hand side was the witness or victim box and to the left was where the defendant was sat. A police officer was placed on the left side of the defendant to guard the public and those present in the court.     The physical organization of the courtroom was highly unusual compared to most everyday settings. The courtroom layout had significant levels of environmental cues relating to the power of the active individuals in the courtroom. The Judge’s bench was elevated and Coat of Arms was placed behind him, the bar table for the lawyers and barristers was at the same elevation as each other, there was deliberate positioning of the court staff between the judge and all others in the courtroom.
