You are a probation officer who was conducting a home visit for probationer Bobby Jean. You walk up to the door, she answers, and you notice a bag of marijuana sitting on the kitchen table. She promises that it is not hers. You provide her with a urine screen and it is clean.
Based on the above scenario, please respond to the following questions: * What would you do? Find out who the marijuana belongs to and ask if they are on probation or parole, do they live there. If they knowingly violated their probation by living together on probation or parole then they both violated their probation and that would be in the report for proper authorities to decide. * Would this scenario lead you into an interrogation or an interview? I want to know whose bag of weed was left on the table and how she was involved; an interrogation would be fitting. I would ask all the appropriate questions so my supervisor can call the shots with any further investigations or demands. Why? She already knows the rules. I am trying to help her do the right things now, for a fresh start and proper foundation for her brighter future. If the bag of weed was her boyfriends and he was living with her and on probation or parole, I would tell her he must move out immediately and she should not have contact with him or I will revoke her probation and she will go to prison. I would find out all the needed information and write it all in my report.

Open with a casual conversation to ease any tension; avoid subjects of politics, religion or social problems. After rapport is

In the first scenario Drugs at a Friend’s House there is a moral problem. As an off-duty officer watching people snorting cocaine at a friend 's party must leave the premises immediately. Before leaving the premises, I will have to inform my friend about her friend 's use of illegal drugs at her own home, dispose the illegal drugs, throw out her friends from the property, and to also inform my good friend that next time it happens, that I will report it to the department, and make an arrest. Educating my friend, whether the she knew of the activity in the first place or not, will teach her that drug use is illegal and is not looked over by me. My friend, friend will be wary next time around, and definitely will have respect for her friend, and me being an officer. But the problem with this option is that if the friend and her friend 's friends do use illegal…

    1. Yes, the search of the vehicle was lawful. The officer smelled marijuana while Ross rolled down the window, during a routine traffic stop, giving the officer probable cause to search the vehicle. The probable cause was based on the officers’ personal observation. “Police officers may use their personal training, experience, and expertise to infer probable cause from situations that may not be obviously criminal.” (Gaines 160) The officer then found a pound of marijuana giving probable cause for arrest.…

There is definitely a moral problem presented in this scenario. I have been put in a very uncomfortable situation as this is a friend of mines party and house but there are individuals within his residence breaking the law by snorting cocaine. Policy and Law does in fact dictate an appropriate response for situations such as these. Professional discretion is not allowed when crimes are being committed, especially if witnessed by a law enforcement officer. I should think about what would be the routes if I turned a blind eye or reported the crime and acted upon the values that were instilled inside of m as an officer of the law. I should also think about the possibility of another law enforcement officer finding out about this incident or possibly if any of the individuals in the bathroom are being surveillance and how that would jeopardize my career and/or life in general. In this situation I would approach my friend and tell him that I had been put in a very awkward/serious situation and tell him what I saw and hope he understands. I will tell him that either he has to report this or I will be forced to. I will tell him that I will do everything in my power to help him out if needed but something has to be done about what is going on in his bathroom.…

The misdemeanor of possession of marijuana includes up to a one year sentence in prison, two-thousand dollar fine and suspended driver's license of persons convicted of this offense for up to ninety days. On the other hand, a felony of possession of marijuana includes a prison sentence of one year and a day up to ten days and a maximum fine up to five-thousand dollars . Sentences including formal probation may also be used in misdemeanor marijuana cases. This can have important implications for a student who is looking for summer or permanent employment outside the mobile area. Regular reporting to a probation officer and random drug screening, along with fees and costs, can make finding or keeping a job difficult. Many job applications require applicants to report any arrests on their record; failure to disclose this information on an application can lead to further legal problems between the student and an employer. Possession of a controlled substance may become a trafficking charge if the drugs weigh enough. Marijuana is classified as a schedule I drug on the basis that is has a high potential for abuse. Marijuana then begins to dominate the user's life. It happens to be that alcohol is perfectly legal but marijuana is not. Alcohol can be twice as deadly as marijuana but if that's the case then why is it not illegal? Marijuana and alcohol should be illegal in most…

Why is so run down on the outside?” I asked Miss Martha. She replied “Thank you I try to keep it up. The outside is a front to keep nosy neighbors out my business. No one expects to find $25,000 dollars worth of ganja in a place like mine.”. I asked Miss Martha how long had she lived in this house, she told me she had been living there by herself for 20 years. She explained to me her children lived in New Orleans and she had not seen them since she came to California in 1982. “How long have you been growing weed here?” I asked. Miss Martha told me she had been growing marijuana for 18 years. She met a man that she fell in love with. He lived in clear Lake and he taught her to grow over 25 years ago. She had been growing weed since 1989. I asked about this man she fell in love with. She told me he is her husband and he is in jail. Miss Martha refused to talk more about him, so I moved on. I wonder if she ever had went to jail from growing. She told me she has come close several times but she had not ever been caught for growing and now she is legit. She has what is known in California as a 99 plant growers license, meaning she can't be arrested by state officials for growing as long as she follows the guidelines and regulation required by the state. “Having so much weed and no one here with you, have you ever been robbed?” I reluctantly asked. “Yes and I made those thieving SOBs pay for it!” Miss Martha shouts “Yeah cousin, she shot one of them in the back with her shoty over there!” Albert says pointing to the shotgun resting on the wall. I asked her what was the most money she ever made selling weed. Miss Martha told me when she was 37 she sold ten pounds to a cruise ship owner in Los Angeles for $35,000 dollars. She told me she can grow up to 40 pounds every 3 to 6 months and she can get $1200 to $4000 dollars a pound depending on quality and who buys it. After about 4 hours of trimming we weighed out what we had trimmed.…
