1 Role and Functions of Law LAW/421 October 6, 2014 Rachel De Angelo 2 Role and Functions of Law Many laws begin as common sense and ethics. In business and society law has function and a role to play. “While there are many sources of American law, the common characteristic of the current state of law is that it creates duties, obligations, and rights that reflect accepted views of a given society.” (Melvin, S.P. , 2011) This current state gives a law a role and function in society and business. Roles of Law There are three classifications that help define the roles of law. Criminal and Civil Law – Criminal law is the law through which public commitment of crimes are prosecuted by governing bodies, whereas civil law is the law through which private parties may bring lawsuits against one another for real or imagined wrongdoings. Substantive and Procedural Law – Substantive laws are the social rights and duties of people, and procedural law are guidelines through which government bodies or courts deal with breaches in substantive law.
